In brief

Please note: borrowing money costs money. Financing business premises, a shop or a residential investment block costs interest, arrangement fees and valuation fees. So look at the total cost of credit over the term and not at the monthly payment, because a longer term reduces the payment and increases the price. For consumer credit the annual percentage rate (APR) makes offers comparable with one another; for business finance that percentage is not always prescribed, so ask for it yourself.

Finass Verzekert advises on and arranges non-life insurance under AFM licence 12016589. Business and mortgage finance fall under different licence categories. For the finance itself we refer you to a firm that does hold that licence; that firm assesses and advises independently.

What we do here is the part the lender requires of you: the buildings or premises insurance, often with the bank as beneficiary. Important in that connection: letting, vacancy and the use of the property must be disclosed on the policy, otherwise the cover is open to question when you claim.

Where things go wrong in practice

Four points at which finance and insurance meet.

The bank requires a policy, but does not check its contents

A lender generally requires buildings insurance and has itself named as beneficiary on the policy. Whether the sum insured matches the rebuild value remains your responsibility. If that sum is too low, underinsurance follows and losses are paid proportionately. Insuring for too much does not help either: under 7:960 DCC a payout must not put you in a clearly better position.

Letting and vacancy must be disclosed

If the use changes — from owner occupation to letting, from office to storage, or the property becomes vacant — the risk changes. If you do not disclose that, you breach the duty of disclosure of 7:928 DCC and the insurer may, under 7:930 DCC reduce or refuse the payout. Vacancy is also covered only to a limited extent under many policies: often just fire, storm and lightning strike.

As the owner you are liable for the building

Under 6:174 DCC the possessor of a structure is liable for damage caused by a defect, even without fault. A facade panel coming loose or a broken handrail is therefore your problem, not the tenant's. Deferred maintenance and defects you knew about are excluded under many policies.

Our role is limited and we say so

We do not provide finance, do not broker it and recommend no lender. Where we refer you to an external party, a fee may be payable for that. You are free to choose a different provider. For the insurance of your property we are indeed your adviser.

What to look out for when comparing

  • Total cost of credit — interest, arrangement fee, valuation and notary costs over the whole term together
  • Term and repayment type — a lower monthly payment almost always means a longer term and more interest
  • Penalty-free repayment — ask in advance what early repayment or selling the property costs
  • Security and guarantees — mortgage right, pledge and whether you sign personally as guarantor
  • Insurance requirement in the deed — which cover the lender prescribes and who is recorded as beneficiary
  • The provider's licence — check the provider and the broker in the AFM register before you sign

How it works

  1. You arrange the finance elsewhereA firm with the appropriate licence assesses your plan, the property and the security.
  2. You look at the insurance requirementThe quotation or the deed states which cover is compulsory and who becomes the beneficiary.
  3. We align the policy with itWe record the rebuild value, the use, the letting and loss of rent expressly.
  4. We keep the policy up to dateOn refurbishment, a change of tenant or vacancy we adjust the cover.

Frequently asked questions

The questions we are asked most often about this.

Does Finass Verzekert arrange the finance for my business premises?

No. Our AFM licence covers general insurance; property finance falls under a different licence category. We refer you to a firm that does hold the licence for it. What we do alongside that finance is the insurance part: the buildings insurance your lender requires, plus loss of rent, vacancy and liability as owner.

Why does the bank require buildings insurance?

The property is the security for the loan. If it burns down uninsured, the security disappears but the debt remains. That is why almost every deed contains an insurance obligation and the lender has itself recorded as beneficiary. Check for yourself whether the sum insured still matches the current rebuild value.

Do I have to disclose letting to the insurer?

Yes. Letting, a change of use and vacancy are circumstances that change the risk. Article 7:928 of the Dutch Civil Code requires you to disclose them when taking out the policy and the policy generally also requires you to report later changes. If you do not, the insurer may reduce or refuse the payout under Article 7:930 DCC.

What happens to cover during vacancy?

Cover is often reduced to a core of perils, usually fire, storm and lightning strike. Damage from burglary, vandalism, frost or water pipes then falls outside the policy. Some insurers impose additional requirements on security and inspection. So report vacancy as soon as it arises, even if you expect it to be temporary.

Is business credit also checked against the BKR?

Every licensed provider consults the BKR (the Dutch credit register) for credit from 250 euros with a term longer than one month. For purely business finance a separate assessment applies, using annual figures, rental income and security. Providers claiming that no check is needed at all generally do not hold the required licence.

Insure your property with us instead?

We compare insurers on premium and conditions and check that the policy matches what your lender requires.
