In brief
Everything that happens with or through a taxi is settled on the motor policy. Article 2 of the Dutch Motor Insurance Liability Act (WAM) prescribes that cover, and with several vehicles it usually runs through a fleet insurance. The public and employers' liability insurance specifically excludes motor damage. It exists for what you do outside the vehicle: helping a passenger to the door, loading luggage, waiting in the hall of a care home, or working in your own garage and at your rank.
The centre of gravity at a business with drivers, however, lies with staff. A driver injured at work cannot recover his own loss under the WAM cover on the car he was driving himself, and the employers' liability section of an AVB generally excludes road accidents. Article 7:611 of the Dutch Civil Code means that as an employer you must make proper provision for staff who use the road professionally. What that provision involves is set out at WEGAS and WEGAM.
Also outside the cover: luggage, wheelchairs and mobility aids belonging to passengers, because that property is in your keeping; third parties' vehicles stored with you or serviced in your workshop, for the same reason; pure financial loss such as a missed flight, a missed appointment or a penalty under a transport contract; and administrative fines and sanctions under a tender. For that last category there is no insurance, only better arrangements.

What to look out for
Four subjects that are decisive at a taxi business with staff.
Your drivers are behind the wheel for the whole shift
No occupational group spends as many hours in traffic. Assess first, therefore, whether the employers' liability on your policy excludes road use, and close that gap with separate road use cover. Include driving and rest times and the policy on phone use in your instructions, because that is the evidence of your duty of care if things go wrong.
Contracted passenger transport increases your duty of care
In school, healthcare and wheelchair transport you carry people who cannot protect themselves. Restraint systems, seat belts, driver training and a certificate of good conduct are no formality here. Whether injury caused during the journey by a wheelchair coming loose falls on the WAM policy or on the AVB is a borderline case: have your insurer confirm that in writing in advance.
Rank, workshop and stored vehicles
On your own premises ordinary business risks apply: a mechanic who injures someone, a pressure washer in the wash bay, a visitor who trips. If you are the possessor of the premises, Article 6:174 of the Dutch Civil Code applies to defects in the structure. Third parties' vehicles you service or store are in your keeping and fall under the care, custody and control exclusion.
Self-employed drivers and subcontractors
If you use self-employed drivers or a fellow operator at peak times, your business can be held liable for their mistakes under Article 6:171 of the Dutch Civil Code, even without a contract of employment. On municipal contracts you also remain the contracting party. Ask for policy schedules, check that their vehicles are insured for the right type of transport and record the recovery arrangement.
What does your premium depend on?
- Payroll and number of drivers: the yardstick for the employers' liability section
- Type of transport: street taxi, contract transport or healthcare and school transport
- Size of the fleet: mainly determines the motor premium and colours the risk profile
- Use of self-employed drivers: and whether their own cover can be evidenced
- Own workshop or storage: servicing third parties' vehicles calls for care, custody and control cover
- Sum insured chosen: often required in tenders

Frequently asked questions
This is what people ask us most.
A driver is injured in an accident he caused himself.
The WAM cover on your taxi pays the other party's damage, but not the driver's own injury. As an employer you are then assessed under Article 7:611 of the Dutch Civil Code: you are expected to have had proper insurance for staff who use the road professionally. If it is missing, you can be left paying your driver's loss yourself.
A passenger falls while getting in or out.
That is the best-known borderline case between two policies. If the injury still arises in connection with the use of the vehicle, the insurer points to the WAM cover. If it arises while helping the passenger across the pavement, it is an ordinary question of care under Article 6:162 of the Dutch Civil Code and therefore AVB. Report such an incident to both insurers and let them sort it out between them.
We lose a contract after an incident. Is that loss insured?
No. Loss of turnover, a contract not renewed or a deduction imposed by a client is pure financial loss without injury or damaged property, and that falls outside public and employers' liability insurance. Liability arising solely from a penalty clause in your transport contract is also excluded. You control that risk with contractual arrangements, not with a policy.
A driver is assaulted by a passenger.
Liability insurance covers your liability, not the offender's. Your driver can, however, hold you liable if you did too little about a known danger: Article 7:658 of the Dutch Civil Code calls for measures such as camera surveillance, a reporting procedure and training in de-escalation. There is also collective personal accident cover for injury to staff.
