In brief

Residential care locations, day care, health centres, mental health practices and home care with a base all have one thing in common: the care has to continue, even if the building is unusable. That sets this page apart from the one-person paramedical practice, where turnover simply stops once the door closes.

Your funding also hangs on care delivered and invoiced: hours, sessions or days of residence that you charge to a health insurer, care administration office or municipality. If the location goes out of action, that output stops while salaries, rent and capital charges run on. The gross profit basis therefore lies close to your turnover.

Keep the sections apart. Rehousing and transport of clients are additional costs and not lost turnover; injury or loss suffered by clients is liability; and failure of your client record system without material damage falls outside this policy.

What does your premium depend on?

  • Gross profit from contracted care. In care that lies close to turnover, because few costs move with output.
  • Nature of the location. Residential care with night cover, day care or treatment rooms alone lead to different recovery times.
  • Number of locations and scope for replacement. If you can take clients in within your own organisation, that limits the loss of turnover.
  • Indemnity period. Set against the recovery of the occupancy rate, not against the building time.
  • Fire prevention and compartmentation. With clients who are less able to help themselves, the evacuation plan, firefighting equipment and fire separations weigh heavily.
  • Excess in days and the sum for additional costs. A generous section for rehousing raises the premium, a longer waiting period lowers it.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

No care delivered, no invoice

Your turnover consists of hours, sessions or days of residence invoiced. If a location goes out of action, chargeable output stops at once, while wage costs, rent and capital charges run on undiminished. The gross profit the policy pays therefore lies close to your turnover. What the cover does not solve is a subsequent adjustment or reclaim by the funding body; that is a contractual dispute and not insured business interruption loss.

Placing clients elsewhere is an additional cost

If a residential location or treatment room goes out of action, the care has to continue. Temporary accommodation, transport of clients, hiring staff and extra night shifts are additional costs and not lost gross profit. They are paid only where additional costs are insured, as a section or through separate additional costs insurance. Work out in advance what it costs to continue the care elsewhere for several months.

Loss suffered by clients falls under liability

If a client is injured in the incident or during the move, that is liability and not business interruption loss. Article 6:162 of the Dutch Civil Code applies to your own wrongful act, Article 6:170 DCC to mistakes by your staff and Article 6:174 DCC to a defective building or installation. The incident report under the Wkkgz (the Dutch care quality act) likewise concerns your liability policy and not this cover.

Occupancy sets the period, not the handover

After repair your location stands empty: clients have been placed elsewhere and staff have left or been taken on by others. It takes months before the occupancy rate is back, and that is exactly what the indemnity period is for. Outside the cover are failure of your electronic client record without material damage and closure by order of the authorities where the building and contents are undamaged.

Does the policy pay for placing clients at another location?

Only where additional costs are insured. Business interruption cover pays lost gross profit; accommodation elsewhere, transport and extra staffing are additional costs. In care, continuing is the starting point, so that section often weighs more heavily here than the cover for lost turnover. Have both amounts set and recorded separately.

What is gross profit when we are funded per client?

Take the invoiced turnover and deduct only the costs that move with the number of clients, such as food, consumables and hired-in self-employed carers. Leave fixed wage costs, rent and capital charges in place, because they run on during a standstill. That leaves a high basis; do not underestimate it when applying.

Our electronic client record is down. Is that covered?

No. This insurance requires covered material damage to your own property as the cause. A failure at your software supplier, a ransomware attack or loss of the internet connection does not produce that damage. For that cyber insurance is needed, which also covers restoration of data and the notification duty.

Our medicine refrigeration failed and the stock has spoiled. What now?

The spoilage itself is loss of goods and runs through your business contents and goods insurance, possibly with a refrigeration or spoilage clause. If the care is interrupted as a result, consequential loss only comes into play where the cause is covered material damage. Report the incident immediately: Article 7:941 of the Dutch Civil Code requires you to notify in good time.
