In brief

A personal home policy assumes you live there yourself. If you let, the insured situation is different: you are not there, you do not see what happens and you depend for signs of maintenance problems on someone with no interest of their own in them.

Insurers translate that into their own landlord products with different exclusions. Wilful damage by the tenant, contamination and damage connected with cannabis growing are the items on which residential letting comes unstuck, alongside liability for defects.

If you let an apartment, the VvE (Dutch owners' association) comes into play; see insuring a let apartment. If it concerns business premises, look at the buildings insurance for premises that are let.

This overview is general in nature and is not personal advice. What is actually covered, including exclusions, limits and the excess, is set out in the policy conditions and the insurance card (verzekeringskaart) of the insurer; you receive both before you take out cover. Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Your maintenance file is your defence

If an occupant is injured by a loose stair rail, a faulty water heater or a sunken threshold, you are liable as possessor under Article 6:174 of the Dutch Civil Code and, as landlord, obliged to remedy defects under Article 7:206 DCC. The question in any claim is always whether you knew about the defect. Record every report with the date, your response and the date of repair.

Damage caused by the tenant

Fire and water damage are covered, even if the occupant caused them. But wilful damage, destruction during an eviction and contamination left behind fall outside the buildings cover. Your recourse then runs through Article 7:218 DCC, which makes the tenant liable for damage to the property let, and through the deposit. Include an inventory report from the start of the tenancy in your file.

Cannabis growing and improper use

A cannabis farm almost always causes fire, damp and installation damage, and insurers exclude that damage or restrict it severely. Your position depends on what you did to prevent it: an identity check beforehand, a ban on commercial use in the agreement, and periodic inspections confirmed by e-mail. Without a file of inspections, a refusal is hard to counter.

Loss of rent and alternative accommodation

If the home is uninhabitable after a covered claim, your rental income stops while the costs continue; that is what the loss of rent section is for. Note the other side too: your tenant is entitled to repairs and can claim a rent reduction. The cost of alternative accommodation for the occupant is rarely included as standard in a landlord cover; ask explicitly whether that item is insured.

What does your premium depend on?

  • Type of letting — Letting to a family, to expats, by the room or short-term is assessed differently in each case.
  • Number of occupants — Occupation room by room means more cooking points and more changes of occupant.
  • Loss of rent included — The period over which lost rent is paid.
  • Condition of the installations — The age of the wiring, central heating and smoke alarms in the home.
  • Screening and type of agreement — An agreement banning subletting and commercial use counts in your favour.
  • Liability section — Landlord's liability for injury to occupants and visitors.

Insurers weigh these details differently. That is why comparing pays off.

Frequently asked questions

The questions we are asked most often about this.

Can I keep my existing home policy running?

Only if the insurer accepts the letting and states it on the policy schedule. For most companies, letting is a change of risk that calls for a different product. If you let the policy run on unchanged, you risk the insurer relying on Article 7:930 of the Dutch Civil Code for any claim, even damage that had nothing to do with the letting.

Who insures the contents in a let home?

The occupant insures their own belongings; you cannot do that for them. If you let part-furnished or fully furnished, what you installed yourself is your property and you need your own contents cover for it. Put it in the tenancy agreement that the tenant must take out home contents and liability insurance, so that damage to your property remains recoverable from them.

What if my tenant does not pay the rent?

Rent arrears are not an insurable loss; loss of rent covers only income that stops because the home is unusable after a covered claim. For debt collection and eviction you need legal expenses insurance (rechtsbijstandverzekering) with a letting module, or a solicitor. Include a deposit in the agreement and keep a record of the payment history.

Do I have to report letting to family as well?

Yes. For an insurer, what counts is whether you occupy the home yourself, not who you are related to. If a family member lives there, with or without a tenancy agreement, the home is occupied by a third party. Report it in writing and keep the confirmation; after a later claim that is the only proof that you met your duty of disclosure.
