In brief

The liability cover pays for damage you cause to others with the speedboat: a collision, damage to a jetty or a quay wall and injury to someone on another craft or in the water. On fast boats this section weighs heavily, because the likelihood of injury is greater. The cover is not compulsory by law, but marinas and slipways almost always ask for it.

The own-damage cover pays for damage to the boat itself: the hull, the engine, the steering gear, the instruments and the fixed fittings. The occupant cover is a separate section and pays a fixed amount on permanent injury to or death of people on board, regardless of who is at fault. On a speedboat that is not a superfluous addition: at high speed, people on board are injured precisely where there is no liable third party.

Pleasure craft capable of more than 20 kilometres per hour, or longer than 15 metres, are required to have the small craft boating licence. Almost every speedboat falls under this. Sailing without the required licence is an exclusion in the policy. See also the general pleasure craft insurance.

There is no statutory insurance requirement for pleasure craft. The WAM applies only to motor vehicles. Marinas, harbours and hire companies do generally require liability cover. Pay attention to the sailing area described and to the lay-up or winter storage period: outside the sailing area or during undeclared storage, cover may lapse.

Where things go wrong with speedboats

Four points that determine whether the policy actually pays out in the event of a claim.

Boating licence and speed are underwriting conditions

For pleasure craft capable of more than 20 kilometres per hour the small craft boating licence is compulsory. The same applies to vessels longer than 15 metres. Almost every speedboat falls within that limit. If you sail without the required licence, that is a standard exclusion and the insurer does not have to pay the own-damage claim. The declared maximum speed and engine power are underwriting conditions too: if you fit a more powerful engine, report it at once, otherwise the policy no longer matches reality.

Water-skiing and tubing call for separate arrangements

Towing water-skiers, wakeboarders or an inflatable is not automatically covered. Some insurers include it under the liability section, others exclude it or ask for a separate module. Injury to the person being towed does not fall under the own-damage cover, and usually not under the cover for people on board either, because that is limited to those on board. If you want to tow, have it recorded that this is permitted and check whether there is separate personal accident cover for people being towed is needed.

Races and sailing area

Taking part in taking part in speed or handling competitions and training for them is excluded as standard. That applies to organised speed trials on closed water too. The policy schedule also states where you may sail: inland waters, a wider area including the IJsselmeer and the Waddenzee, or coastal waters and abroad. If you sail outside it, there is no cover, not even for liability. If you take the boat abroad, ask for an extension in advance and check the description of the area.

Storage, transport and your own obligations

Theft is covered subject to conditions: a certified motor lock, security bolts and storage on a locked site. Damage during transport on the trailer is not automatically covered, and the trailer itself is never covered by the boat policy. During the winter storage a lay-up period with limited cover applies; frost damage because the engine or the cooling system has not been drained is not covered. Wear and tear, osmosis, corrosion and deferred maintenance are covered nowhere. Damage caused deliberately or recklessly is excluded (Article 7:952 of the Dutch Civil Code); state the use and the power correctly (Article 7:928 of the Dutch Civil Code) and report a claim in good time (Article 7:941 of the Dutch Civil Code).

Do I need a boating licence for a speedboat?

For pleasure craft capable of more than 20 kilometres per hour, or longer than 15 metres, the small craft boating licence is compulsory. Almost every speedboat falls under this. If you sail without that licence, it is an exclusion in the policy: the own-damage claim is not paid and the liability cover can lapse as well.

Am I insured if I tow someone behind the boat?

Not automatically. Water-skiing, wakeboarding and tubing are included under the liability section by some insurers and excluded, or covered only through a separate module, by others. Injury to the person being towed also usually falls outside the cover for people on board, because that is limited to those on board. Have the use recorded in advance.

May I take part in races on this policy?

No. Taking part in speed or handling competitions and training for them is excluded as standard, including on closed water. A few insurers offer a separate arrangement with restrictions and a higher excess. Declare participation in races when you apply; reporting it afterwards does not help, because when a claim arises, what was in the policy at that moment is what counts.

What happens if I fit a more powerful engine?

Report it straight away. Engine power and top speed are both a premium factor and an underwriting condition. If the actual equipment differs from what is stated on the policy, the insurer can reduce or refuse payment under Article 7:930 of the Dutch Civil Code. Where there is a substantial increase in power, the insurer may no longer be prepared to accept the risk at all.

What applies during transport and winter storage?

Damage during transport on the trailer is not automatically covered. That varies from policy to policy. You insure the trailer itself separately or through the trailer cover on your motor insurance. During the lay-up period, cover remains limited to events such as fire, storm and theft, and frost damage from a cooling system that has not been drained is excluded.
