In brief

There is no price list from which an insurer can read off the value of a yacht. The value is therefore established in advance by a recognised valuer, and that agreed value is binding between you and the insurer under Article 7:960 of the Dutch Civil Code . That prevents a discussion about market value from arising after a fire or a sinking, at the very moment when the vessel can no longer be inspected.

A valuation has a limited period of validity. If it expires and you do not have a revaluation carried out, a claim falls back on the open market value at the date of loss. On larger vessels that difference runs high. Conversions, a new engine or additional navigation equipment also belong in an updated valuation; otherwise they are effectively not covered.

The second thing that sets a yacht apart from smaller pleasure craft is the crew. As soon as you employ or regularly hire a skipper, deckhand or stewardess, employer obligations apply. That liability does not run through your hull policy. If you sail abroad, also read what the sailing area means at boat insurance.

There is no statutory insurance requirement for pleasure craft; the WAM applies only to motor vehicles. Marinas, harbours and hire companies do generally require liability cover. Pay attention to the sailing area described and to the lay-up or winter storage period: outside the sailing area or during undeclared storage, cover may lapse.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

The valuation is the core of the policy

A valuation by an expert fixes the value in advance and binds both parties; Article 7:960 of the Dutch Civil Code gives that assessment its force. Without a valid valuation, the surveyor assesses the value only after the loss, when the vessel is no longer there. Have the valuation renewed in good time and report investments in the engine, navigation or interior in the meantime, because only what is in the report counts.

Crew makes you an employer

With a skipper or crew member in your employment, injury on board falls under the employers' liability provisions of Article 7:658 of the Dutch Civil Code, with the burden of proof on you. For damage your crew causes to third parties, Article 6:170 of the Dutch Civil Codeapplies. Both fall outside the hull cover and outside the ordinary liability section for pleasure craft. Arrange that cover before anyone comes on board, even for a single permanent skipper.

The passage to the sailing area is a risk of its own

Many owners have their vessel taken to the sailing area in spring, by a delivery skipper or on a transport ship. That move is by no means always within the ordinary cover: transport by road or on deck is often subject to a separate transport clause, and with a hired skipper the question is who was in command. Report this in advance.

The tender in the davits is a second craft

A tender with its own engine is, for insurance purposes, an independent craft. If it is torn loose in a heavy sea or stolen from the davits, the question is whether it appears on your policy and at what value. Liability matters too: if someone takes the tender ashore, that is use away from the mother vessel. See insuring a tender.

What does your premium depend on?

  • Agreed value — The amount in the valuation report is the basis for calculating the hull premium and the excess.
  • Length and displacement — Larger vessels involve considerably higher costs in a collision and in salvage than light craft of the same value.
  • Sailing area — Inland waters, coastal waters and sea areas are assessed differently, as is the question of whether you keep sailing outside the season.
  • Crew and use — Private use, use with permanent crew, and hire or charter are three different risks with their own conditions.
  • Mooring and winter storage — A supervised marina or a shed indoors is judged differently from an open mooring where the vessel stays all year.
  • Excess and claims history — On larger vessels a higher excess is often chosen; previous claims count in the assessment.

How long does a valuation remain valid?

Insurers apply a fixed period of validity, which is stated in your policy. Once it expires, the binding effect ends and the insurer reassesses the value when a claim arises. Have the revaluation carried out well before it expires and send in the new report, even if you think the value has not changed. Without a current report you fall back on the value at the date of loss.

May I hire out my yacht or put it into charter?

Not without declaring it in advance. A pleasure craft policy assumes private use by you and your guests. Hire is commercial use and calls for different cover, not least because you then become liable for the conduct of a hirer you do not know. If you hire the vessel out without declaring it, you risk the insurer refusing to pay.

Is the tender automatically covered?

Only if it appears on the policy with its own value, and often subject to a limit on engine power. A tender used independently to go ashore falls outside the liability cover of the mother vessel under many policy conditions. Give the make, type and engine power, together with the way the tender is secured on board.

What applies if I hire a skipper for the passage?

Report the passage in advance and record who is in command. A hired delivery skipper is not a passenger but the person in actual charge, which has consequences for liability and sometimes for the hull cover. Some insurers set requirements for the skipper's qualifications or for the number of people on board during the passage.
