In brief

Cleaning, window cleaning, security, reception services and grounds maintenance share one feature that shapes the policy: the property you work on and in is not yours. That makes care, custody and control not an extension but the core of your cover. A bare public and employers' liability policy specifically excludes damage to property in your custody, and that is precisely the category your work takes place in.

You also hold access. Keys, tags and alarm codes for dozens of sites sit in your office or in the van. If a key to a master suite is lost, the loss consists of rekeying the whole building: pure financial loss without anything being broken. No standard section pays for that. There is separate key loss cover for it.

If you pass work on to a subcontractor, you remain answerable to your client under Article 6:171 of the Dutch Civil Code. For mistakes by your own staff Article 6:170 DCC applies. We set your list of sites, your key management and your hired-in labour side by side and build a SME insurance package around them.

What does your premium depend on?

  • Number of sites managed. How many buildings you serve and how large the stock of keys and codes is.
  • Type of services. Window cleaning and facade maintenance at height carry more weight than interior cleaning at ground level.
  • Care, custody and control limit per event. Matched to the value of the contents at the most expensive site you attend.
  • Key loss cover. Whether or not it is included, and with what limit per master suite.
  • Hired-in staff. Agency workers, self-employed cleaners and subcontractors all count towards the payroll.
  • Type of environment. Working in data centres, laboratories or care institutions brings higher consequential loss than office cleaning.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Keys and codes are a separate type of loss

Losing a key from a master suite does not result in damaged property but in the cost of replacing cylinders throughout a building. That is pure financial loss and falls outside ordinary liability cover. Ask for key loss cover with a limit that matches the largest master suite in your portfolio, and record who holds which key.

Damage to the surface you are treating

The wrong cleaning agent on natural stone, too much pressure on pointing or an abrasive pad on coated aluminium causes damage to exactly the thing you were hired for. Damage to the item you are working on is excluded on virtually every policy, or covered only under care, custody and control, with its own limit. So work with recorded cleaning instructions for each site.

A visitor slipping on your wet floor

As soon as you mop in a public space you create a hazard you have to screen off. If the warning is missing and someone falls, injury liability follows under Article 6:162 of the Dutch Civil Code, along with an argument with the building manager about who should have cordoned off the area. Set out in your work instructions that signs stay in place until the floor is dry, and photograph that during major cleaning rounds.

Hired-in labour, agency workers and work passed on

Facilities contracts are often passed on to subcontractors or filled with agency workers. You are liable for subordinates under Article 6:170 of the Dutch Civil Code, and for non-subordinates carrying out your business activities under Article 6:171 DCC. Declare hired-in workers to the insurer. If they are left out of the declaration, the payroll figure is too low and the payment can be reduced proportionally.

This is what people ask us most.

Is damage to my client's contents covered?

Only with a care, custody and control module. Standard liability cover excludes property in your custody, and in facilities work that is virtually everything around you. The limit has to match the most expensive site in your portfolio, not the average. Report it when you add a building with costly equipment to your list.

Who pays for rekeying after a key is lost?

Without separate key loss cover, you do. It is pure financial loss: nothing is damaged, but the master suite is no longer reliable. Liability policies do not cover that type of loss as standard. So ask expressly for this extension and match the limit to the largest master suite for which you hold keys.

Am I liable for a subcontractor I bring in?

Towards your client, usually yes. Article 6:171 of the Dutch Civil Code makes you liable for mistakes by non-subordinates carrying out work that forms part of your business activities. Your client therefore does not have to approach the subcontractor. So check whether the subcontractor has its own cover and whether your policy includes third parties you engage.

Am I covered if I work outside office hours?

Yes, provided those working hours have been declared. Evening and night work without the client's own staff present does change the risk profile: there is no supervision and access runs entirely through your keys. Insurers sometimes attach conditions to that, for instance about alarm response and recording the issue of keys.
