In brief

With continuous CAR insurance you do not notify projects separately. Everything that falls within the activities described is insured as soon as you take it on. That saves administration and prevents a small works from starting uninsured by mistake.

Against that stand two limitations. The first is the maximum contract sum per works: a project above it falls outside the cover entirely, not partly up to the limit. The second is the contract term of the policy itself, which determines what happens to works still in progress if you cancel or switch.

The premium is calculated on annual turnover, with an adjustment afterwards. Your declaration is a statement to the insurer and is treated as such when you claim.

What does your premium depend on?

  • Estimated annual turnover. The basis of calculation for the provisional premium, adjusted afterwards against the actual turnover.
  • Maximum contract sum per works. The higher you set that limit, the more risk the insurer can run on a single works.
  • Split between new build and existing buildings. Work on existing buildings brings damage to other people's property with it and weighs more heavily.
  • Nature of the activities described. Structural work, roofing and earthworks are assessed differently from finishing.
  • Claims record of previous years. Under a continuous contract your own claims history counts at renewal.
  • Sections insured and excess. Existing property, ancillary plant and the level of the excess steer the premium.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

The limit per works is an all-or-nothing limit

This is the mistake made most often with this type of policy. If the contract sum of a project is above the agreed maximum, that works is not partly insured but not insured at all. Insurers also look at connected works: successive part-orders for the same client on the same structure can be treated as one works. Splitting them up therefore does not solve the problem; a separate short-term policy for that project does.

The turnover declaration is more than a calculation item

You first pay a provisional premium based on an estimated annual turnover, and afterwards an adjustment follows on the actual figures. Keep your project records so that you can substantiate that declaration. A structurally low estimate leads not only to an additional charge but also, on a large claim, to the question of whether you informed the insurer correctly. Article 7:928 of the Dutch Civil Code governs that duty of disclosure when the policy is taken out.

When switching, watch the works that continue

If you cancel the policy, the cover stops on the contract date, while your works simply continue. Arrange expressly on the application for the new policy that works already started are included, or have a run-off period recorded on the old policy. The same applies to maintenance periods for works already handed over. We always put that transition in writing when switching, precisely because a gap can arise here.

Continuous does not mean unlimited

Outside the cover are, among other things: works above the limit per works, activities not stated in the description of your capacity, such as demolition, piling or work abroad, and putting right your own defective workmanship. Damage you already knew about when you took out the policy also falls outside it. Report a claim as soon as you know of it; Article 7:941 of the Dutch Civil Code attaches consequences for the payout to late notification.

Existing property is the most commonly missed section

If you work in or on an existing building, that building is not your works but the property of the client. Damage to it does not fall under section 1 and, on your AVB, falls under the care, custody and control exclusion. The section existing property fills that gap, and with conversions, renovations and installation work that is not an edge case but the core of the risk.

The maintenance period continues after handover

After handover there is often a maintenance period during which you remain liable for defects that arose during construction. Agree that period explicitly and have it stated on the policy. Under the Wet kwaliteitsborging (the Dutch Building Quality Assurance Act) this carries more weight: Article 7:758(4) of the Dutch Civil Code places the burden of proof for hidden defects on the contractor.

Do I have to notify every project?

No, that is the characteristic of this form: works within the activities described and below the limit per works are covered without notification. Notification is only needed for projects that fall outside that, for example because the contract sum is higher or because you are doing work that is not stated in the description of your capacity.

What happens with a project above the maximum?

That works is not insured, not even for the part up to the limit. You take out a separate project policy for it, with its own term and its own contract sum. Do that before the works starts. An insurer will not accept insuring a works that has already begun.

How does the adjustment work?

After the end of the insurance year you declare your actual turnover from contracted work. If it is higher than the estimate, an additional charge follows. If it is lower, a refund follows, often with a minimum premium as a floor. Submit the declaration on time, because failure to do so can lead the insurer to make its own estimate.

Do works in progress stay covered if I cancel?

Not automatically. The cover follows the term of the contract, not that of your projects. On cancellation, agree that works started during the term remain covered until handover, or have the new insurer take them over expressly. Do not forget the maintenance periods that are running.
