In brief
SME versions of liability insurance are designed for businesses with a straightforward risk: one fixed activity, a limited turnover and a limited number of employees. Underwriting is therefore quick, but the policy is tightly defined. The described business activity on the policy schedule determines what is insured. If an installation firm takes on maintenance contracts, a shop starts doing its own fitting or a caterer takes on staff, practice departs from the description and a claim can fall outside the cover.
On these policies the premium is almost always calculated on a basis: annual turnover, payroll or both. At the end of the insurance year there is an an adjustment at the end of the year. If you give too low an estimate, you pay the difference afterwards; and giving incorrect information can also affect the payment under the Articles 7:928 and 7:930 of the Dutch Civil Code. If you grow beyond the upper limit of the SME version, a regular business policy is often more suitable than renewing the existing one.
Such a policy is usually offered as part of a package, together with business contents, business interruption and legal expenses cover. Watch out for overlaps and gaps: a business legal expenses insurance conducts a dispute but pays no compensation; a business contents insurance covers your own property and not someone else's. Four points that lead to discussion on a standardised SME policy more often than the level of the premium.
Exactly who is covered
Besides the business, the owner, the directors and subordinates are usually insured. Trainees, volunteers, agency workers and family members working in the business are not always covered. Your duty of care does apply to hired-in staff: Article 7:658(4) of the Dutch Civil Code counts them as your responsibility, even if their contract is elsewhere. Check that list in the conditions.
Premium adjustment and the basis declared
Give realistic figures for turnover and payroll and correct them during the year if you grow strongly. An adjustment leads to an additional premium invoice. A structurally low declaration can weigh more heavily when a claim arises, because the insurer can then rely on Article 7:930 of the Dutch Civil Code to reduce the payment.
What is excluded as standard
Excluded are, among others intent and wilful recklessness (Article 7:952 of the Dutch Civil Code), fines and penalty payments, damage under care, custody and control to third parties' property, damage caused with a motor vehicle (Article 2 of the Dutch Motor Insurance Liability Act) and claims arising from contractual guarantees or penalty clauses that go beyond your liability in law.
Deliveries and work outside the Netherlands
SME policies often have a limited territorial scope. If you supply customers outside Europe, or send fitters to a site abroad, check the territorial scope and the separate exclusion for the United States and Canada. That exclusion is standard and can only be lifted by a clause.

When does an SME version no longer suit my business?
As soon as you exceed the product's turnover or staff limit, start activities that fall outside it, or supply clients who impose their own purchasing conditions. A tailored policy is then wiser, with a broader description of capacity and clauses that match your contracts. We assess that at renewal.
What happens if my activities change?
Report the change in writing, including during the policy year. The capacity on the policy schedule is the boundary of the cover, and an unreported extension falls outside it. Insurers usually amend the description without objection, possibly at a different premium. Reporting afterwards no longer helps once the damage has been done.
Is legal expenses cover automatically part of the package?
No. Liability insurance does defend a claim brought against you, but it does not help if you want to pursue someone yourself, in a collection dispute or in a conflict with an employee. For that you need a separate legal expenses insurance for SMEs needed.
Does the policy cover damage to the product I supplied myself?
No. The cost of repairing or replacing your own product or work is for your account, as is the cost of a recall. What is covered is the damage your product causes to someone else, for example where a defective coupling causes water damage in a home. That distinction determines whether a claim falls under the policy.
