In brief

Insurers assess a day nursery on how easily it can be evacuated. Babies and toddlers do not walk out by themselves; each member of staff can take only a few children at a time. That makes the width of escape routes, the position of the sleeping rooms, self-closing doors and a fire alarm system with signalling questions of acceptance, and not non-binding advice.

The second point is the change of use. Many childcare locations are in a former house, a school wing or a business unit. As soon as day care moves in, the original declaration on the policy is no longer correct. If you do not report that, on a claim the insurer can rely on your duty of disclosure under Article 7:928 of the Dutch Civil Code.

The third point is outside: play equipment, a store, a shed for outdoor cots and the boundary fencing. Those belong to the structure but rarely appear on the policy. If your location is in a school building, also look at the buildings insurance for schools.

Optional

Extensions

What is excluded as standard.

What is covered

SituationStandardWith extension
Fire, smoke and lightning strikeYesYes
Storm from force 7 upwardsYesYes
Water damage from a burst pipeYesYes
Glass breakageSometimesYes
Groundwater coming through the floorNoNo
Wear and deferred maintenanceNoNo

This overview is general in nature and is not personal advice. What is actually covered, including exclusions, limits and the excess, is set out in the policy conditions and the insurance card (verzekeringskaart) of the insurer; you receive both before you take out cover. Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Evacuation determines acceptance

Sleeping rooms on an upper floor, a single staircase or a kitchen in the escape route weigh more heavily with an insurer than the year of construction. Expect clauses about smoke alarms, self-closing doors between rooms, clear circulation routes and an annual evacuation drill. If such a clause is not met and that is connected with the damage, payment can be reduced or refused. So record inspections and drills.

Converting a house into a nursery

Knocking through walls, extra sanitary ware at child height, a suspended ceiling with recessed lighting and extra circuits in the consumer unit change the property fundamentally. Report the work in advance and have the rebuild value reassessed. Damage caused by inherent defect to a structure altered without a permit or without an approved installer is excluded, as is damage arising during the work itself without separate construction all risks (CAR) cover.

Outdoor space and play equipment

A climbing frame, a sandpit canopy, fencing and an outdoor store fall under the structure as long as they are permanent fixtures and appear on the policy. Free-standing equipment counts as business contents. If a child is injured by rotten play equipment, that is not buildings damage but your liability as possessor under Article 6:174 of the Dutch Civil Code. Keep the inspection reports for your equipment.

What is not included

Not covered are: vandalism and burglary damage to the building where an agreed security clause has not been met, damage from deferred maintenance to the roof or window frames, and groundwater rising through the floor. Pure financial loss such as missed childcare fees during a closure also falls outside the buildings cover; that requires business interruption cover. Liability towards parents and staff likewise runs through another policy.

What does your premium depend on?

  • Number of childcare places and group layout — The number of children present at the same time weighs more heavily than the number of square metres.
  • Position of sleeping rooms and escape routes — Sleeping on the ground floor with a direct exit is assessed more favourably than bedrooms on an upper floor.
  • Fire detection and compartmentation — A certified fire alarm system with signalling and self-closing doors limit the extent of a fire.
  • Kitchen fittings and heating — A production kitchen with a fryer or gas cooker is rated differently from a kitchenette for snacks.
  • Outdoor area and play equipment — Fixed equipment, canopies and stores count towards the rebuilding sum and towards the risk assessment.
  • Security outside opening hours — A location that stands empty after half past six is assessed on burglary resistance and on detection.

Insurers weigh these details differently. That is why comparing pays off.

Frequently asked questions

The questions we are asked most often about this.

Does the play equipment fall under the buildings insurance?

Only if it is fixed in the ground and described on the policy. Free-standing equipment, outdoor cots and play materials belong to the business contents. If a child is injured by defective equipment, that is liability and not buildings damage; the insurer assesses that claim under Article 6:174 of the Dutch Civil Code and your inspection records.

We are in rented premises. Who insures what?

The owner insures the structure. What you had installed yourself, think of lowered washbasins, wall coverings, kitchen units and partitions, is tenant's interest and you insure it yourself. Record in the tenancy agreement who carries the glass cover and the installations, otherwise it turns out after a claim that neither policy covers that item.

Do I have to report that the property is now a nursery?

Yes, always and in advance. Day care with sleeping children is a different risk from residential, office or retail use. Article 7:928 of the Dutch Civil Code requires you to disclose, when taking out the policy, everything relevant to the assessment. If the use changes later, for example by adding evening care or after-school care, report it again.

Is the income we lose after a fire included?

No. Buildings insurance pays for repair or rebuilding of the building, not for the fees you lose while you are closed. There is separate business interruption cover for that, which can also include the cost of temporary premises. Discuss the indemnity period for it with your adviser, because rebuilding childcare locations often takes longer than expected.
