In brief

The insurance chain contains two parties with their own role and their own supervision. The insurer carries the risk and is subject to prudential supervision by De Nederlandsche Bank, which checks whether there is enough capital to pay future claims. The adviser or intermediary is subject to conduct supervision by the AFM and needs a licence for that under the Dutch Financial Supervision Act.

That distinction is a practical one. If the question is whether a loss is paid, the insurer decides on the basis of its conditions. If the question is whether you were given a suitable product, the adviser can be held responsible. Both routes end, if need be, at Kifid or in court.

What we can and cannot promise

Two sides of the same story, because a promise without limits is no promise at all.

Handling your data carefully

Personal data is needed for a quotation: address, claims history and sometimes medical or criminal record details. That processing falls under the GDPR and under the sector's codes of conduct. Insurers also consult the Stichting CIS database to check claims history and fraud indicators. You may always ask which data about you has been recorded.

Stichting CIS

What is outside our control

We cannot guarantee that cover will be accepted and cannot promise a payment: that remains for the insurer. The exclusions still apply, including for wear, deferred maintenance and inherent defect, for war risks and nuclear reactions and for damage caused by intent or recklessness under Article 7:952 of the Dutch Civil Code. Your own obligations also continue to apply: giving correct information when taking out cover (Article 7:928 of the Dutch Civil Code) and reporting a loss in good time (Article 7:941 of the Dutch Civil Code).

What does your premium depend on?

  • Nature of the risk — what and who you insure
  • Sum insured — rebuild or replacement value
  • Type of cover — limited, extended or comprehensive
  • Excess — higher amount, lower premium
  • Claims history — registered with Stichting CIS
  • Insurance premium tax — 21% on non-life insurance

Insurers weigh these details differently. That is why comparing pays off.

Frequently asked questions

The questions we are asked most often about this.

Who supervises insurers?

Two supervisors, each with its own task. De Nederlandsche Bank exercises prudential supervision: can the insurer meet its obligations in the long run, measured against European solvency requirements. The Netherlands Authority for the Financial Markets exercises conduct supervision: is the information correct, is the product suitable and is the customer treated with due care. Advisers and intermediaries fall only under that conduct supervision.

What happens if an insurer gets into difficulties?

Insurers have to meet capital requirements continuously and report on this to De Nederlandsche Bank, which can intervene before things go wrong. Unlike with bank savings, there is no guarantee scheme for general insurance that takes over payments. That is a reason, when comparing, to look not only at the premium but also at the insurer itself.

Where does it say how you are paid?

In the services document you receive before the advice. With ordinary general insurance the remuneration usually runs through commission included in the insurer's premium. For complex and high-impact products a commission ban applies and you agree a fee in advance. You may always ask which form applies in your case.

Are you tied to an insurer?

No. We act as an intermediary for the products of a large number of insurers and are not an authorised agent for any single party. Which companies are included in the comparison is set out in the services document. If an insurer will not accept your risk, because of the construction type or claims history for example, we put it to another party.

Would you rather ask your questions first?

Ask for advice without obligation; you receive the services document and the conditions in advance.
