After a collision that was the other driver's fault, nobody automatically comes along to pay for your loss: recovering it is up to you, and that is exactly what traffic legal expenses cover exists for.

Traffic legal expenses cover is about recovery. Someone runs into you, your car, motorcycle or caravan is damaged and you may be injured. The other party's liability follows from Article 6:162 of the Dutch Civil Code, and under Article 2 of the Dutch Motor Insurance Liability Act (WAM) you can approach his third-party liability insurer directly. That insurer looks after the interests of its own customer; the lawyer on your policy looks after yours.
Alongside recovery after an accident, this area of law covers the disputes that arise around it: a repair that is not up to standard, a used car with a concealed defect, a discussion about the market value or a recovery firm charging too much. For the loss you cause to someone else it is not this policy but your liability insurance or the third-party cover on the vehicle that applies.
Outside the cover are fines and their costs, driving without a valid licence, driving under the influence, taking part in speed competitions and disputes that already existed when the policy was taken out.
The structure of the cover in three parts, with an overview per situation below.
The basic cover insures the essentials; we show what Unigarant and other insurers offer here.
As well as debt collection and contracts, also employment law, disputes about your business premises and disputes with public authorities.
The most complete cover. We compare Unigarant's extended versions with the market.
What is covered
| Situation | Basic | Extended |
|---|---|---|
| Dispute with a contractor about work on your home | Yes | Yes |
| Recovering damages for personal injury after a collision | Yes | Yes |
| Employment dispute or dismissal | Provided that | Yes |
| Dispute about a purchase or a delivery | Yes | Yes |
| Tax dispute or dispute about assets | No | Provided that |
| A dispute that was already running before the start date | No | No |
Legal expenses insurance has a waiting period after the policy starts and a threshold: a case is not taken on below a certain financial interest. If the case goes to court, you have a free choice of lawyer. A dispute whose cause already existed when you took out the insurance is excluded.

This overview concerns our service, not the cover. What is actually covered is set out in the policy conditions and on the insurer's insurance card (verzekeringskaart); you receive both before you take out cover.
Four points that make the difference between a policy that pays out and one that does not.
If you have no own-damage cover, recovery is the only route to being paid for your own loss. The lawyer holds the other party liable, resists any argument of contributory fault and negotiates on the amount. The evidence from the first half hour is crucial: an accident statement form completed and signed by both parties, photographs of the final positions and the names of witnesses. Without those it soon becomes one word against another.
With injury it is not just about the car. Loss of income, help in the home, adaptations to the house, damages for pain and suffering and future loss all belong to it, and that process often runs for years. In injury cases the reasonable costs of legal assistance are usually borne by the liable party's insurer. Never sign a final settlement while the medical position has not stabilised, because that closes the case for good.
If you buy a second-hand car, motorhome or caravan that shows a serious defect soon afterwards, that is a dispute about non-conformity. Buying from a dealer puts you in a stronger position than buying from a private seller, where more of the investigation is up to you. Have the defect established independently before you have it repaired; a repair you arrange yourself makes it almost impossible to prove the original condition.
If the accident happens outside the Netherlands, liability is judged under the law of that country, with different limitation periods and different levels of compensation. Check that your policy has an area of cover including the country you are travelling in and that the towed unit is included. Keep the foreign police report, because in many countries recovery is practically impossible without one.
Retroactive cover (prior risk) Included for your staff during work.
Insurers weigh these details differently. That is why comparing pays off.
Customers rate our service on four aspects: personal service, service delivery, availability and the outcome. The reviews are collected and published by NH1816 and come from customers who have actually taken out a policy with Finass Advies B.V. or reported a claim.
The questions we are asked most often about this.
Often yes. Your motor insurance pays for the other party's loss and, with own-damage cover, for your own. It does not run a case on your behalf against the other party. Some motor policies contain limited recovery assistance, but that stops as soon as proceedings or personal injury are involved. Check your policy schedule before you assume it is already arranged.
You can then call on the Waarborgfonds Motorverkeer, which pays for loss caused by unknown, uninsured or stolen vehicles. Strict conditions apply: with an unknown driver you have to make it plausible who or what caused the damage, and report it to the police. The lawyer on your policy can submit that application for you and challenge a refusal if necessary.
You always pay the fine yourself; it is never insurable. Assistance with a defence or a notice of appeal can be covered where the offence is wrongly attributed to you or where a driving ban is threatened. In cases of intent, driving under the influence or driving without a valid licence that assistance falls away and you are on your own.
If the other party's liability is established, the reasonable costs of legal assistance are usually borne by their insurer. If liability is still under discussion or is disputed, your own legal expenses policy bears the costs within the agreed maximum. In both cases it pays to report early, before one-sided proposals are on the table.
