In brief

A authorised agent writes insurance on behalf of one or more insurers. It accepts the risk, draws up the policy and handles claims, but the risk is borne by the insurer behind the agency. For you that means: your policy has its own set of conditions, which may differ from the conditions the same insurer uses directly. So always compare the set of conditions actually named on your policy schedule, and not the brand name.

We compare underwriting agency products on the same points as the rest: the description of cover, the exclusions, the excess and the clauses. In some areas an agency leads to shorter lines in claims handling, because acceptance and claims sit under one roof. In other areas a policy from the insurer itself is wider. We compare several insurers objectively; the choice follows from the cover required, not from the channel.

What stays the same everywhere are the firm exclusions. War risks and nuclear reactions are excluded, as is damage caused by intent or recklessness (Article 7:952 of the Dutch Civil Code) and damage caused by flooding from a primary flood defence. Wear and tear and inherent defect also fall outside cover: insurance reimburses a sudden, unforeseen event and not deferred maintenance. For the products in this section, start at trailer insurance.

This page deals with one situation. The full overview is on Compare trailer insurance.

What to look out for

Four points that are different with an agency policy than with a policy taken out directly with the insurer.

Which set of conditions appears on the policy schedule

The name of the risk carrier on your policy does not tell you which conditions apply. Look up the conditions number on the policy schedule and read that set. Differences often lie in details that only show up at claim time: the definition of theft, the requirement of signs of forced entry, the valuation basis or the number of years of replacement-value-as-new cover.

Who handles the claim

With an agency, the underwriting agent handles claims itself, within the limits of its authority. Larger or unusual files go to the risk carrier. For you the route does not change: you report to us and we guide the file. Report in good time, because Article 7:941 of the Dutch Civil Code requires you to notify as soon as you are reasonably aware of the loss.

Your rights remain the same

The statutory rules of Title 7.17 of the Dutch Civil Code apply in full: the duty of disclosure under Article 7:928 of the Dutch Civil Code on entering into the contract, the consequences of Article 7:930 DCC in the event of non-disclosure, and the prohibition on enrichment under Article 7:960 DCC when the loss is assessed. An underwriting agency is a form of distribution, not a separate legal category.

When switching, the set of conditions goes with it

If you move from an agency policy to a direct policy or the other way round, the whole set changes. Check whether extensions you had — extended theft cover, a valuation, wider care, custody and control cover — have been arranged again in the new situation. They do not carry over automatically.

What does your premium depend on?

  • Item and insured value — the basis of every premium calculation
  • Type of cover chosen — third-party liability, third-party, fire and theft, or comprehensive
  • The product's set of conditions — a wider set costs more premium
  • Excess — per event or per year
  • Security and storage — set out in the clauses
  • Claims history — taken into account in acceptance and premium

Insurers weigh these details differently. That is why comparing pays off.

Whether your policy runs through an underwriting agency or directly does not change these outcomes; the form of cover chosen does.

Frequently asked questions

The questions we are asked most often about this.

What exactly is an underwriting agent?

A party that may independently accept insurance, draw up policies and settle claims on behalf of one or more insurers. The risk remains with the insurer behind the agency, which is named as risk carrier on your policy. In practice you mainly notice it in the conditions and in the speed of claims handling.

Am I less well protected under an agency policy?

No. The same statutory rules and the same supervisory frameworks apply. The difference lies in the set of conditions and in who handles the file. We therefore assess an agency product on exactly the same points as a policy from the insurer itself: what is covered, what is excluded, which clauses appear on it and how the loss is assessed.

Who should I address in a dispute about cover?

Us first: we conduct the discussion on your behalf with the underwriting agent or the risk carrier. If that does not resolve matters, the internal complaints procedure is open and thereafter the route to the complaints institute for financial services. Your policy schedule and our services guide state which route applies; you can find it at the services guide.

Can I place my whole portfolio with one underwriting agency?

You can, but it is not an end in itself. We look policy by policy at which conditions fit best. Sometimes that is an agency product, sometimes a policy directly with a company. A package discount does not outweigh cover that falls short on an important point, because at claim time only the policy the loss falls under counts.
