In brief

Anyone putting trips together or selling packages buys in from others: a hotel, a coach driver, a diving school, a local guide. If something goes wrong there, the first question is not whether you were present but whether you chose and checked that party with due care. That test runs through Article 6:162 of the Dutch Civil Code, and where you engage someone else for work forming part of your business, Article 6:171 DCC is added. Your file on the selection is then the evidence.

You also face an obligation that is not insurance. For package holidays you are required by law to provide security in case you become insolvent , so that travellers get their money back or are brought home. You arrange that through membership of a guarantee scheme with its own entry requirements and its own contribution. Do not confuse it with liability or travel insurance; it covers your insolvency, not your mistakes.

A third point is often overlooked: the guest's travel insurance is are policy, not yours. Repatriation, medical costs and lost luggage of the traveller run through it. Your own cover only starts where you are liable for injury or property damage, and where your business itself suffers loss through cancellation, a supplier failing or a destination being closed off.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Record how you select partners

For each accommodation, transport operator and activity provider, note which criteria you applied, which insurance and safety evidence you asked for and when you last checked it. If a guest drowns at a provider with no lifeguard, that file is the difference between a defence and a settlement. Add annual rechecks to the process; a certificate from the first year of the contract means nothing at an incident four seasons later.

If you accompany guests yourself, a different risk starts

As soon as your own tour leaders, guides or instructors go out with guests, the discussion shifts to supervision and instruction. For active activities — cycling, sailing, climbing, winter sports — that activity has to appear on your policy in so many words. A general description such as tour operator usually does not cover guided adventure programmes. Declare the nature and frequency, even where it is only a few weeks a year.

Your territory is rarely worldwide

Policies have a territorial description and that is not always worldwide. If you add a destination outside Europe, or go to an area subject to negative travel advice, report it beforehand. Working in areas of war or unrest is also excluded as standard, as are the consequences of strikes, airspace closures and natural forces. You carry those items yourself or cover them contractually in your travel conditions.

Cancellations and booking errors are not property damage

A name passed on incorrectly, a flight missed because of your scheduling or a room double-booked costs money without anything being damaged. That is pure financial loss and it falls outside public and employers' liability insurance; professional indemnity cover is needed for it. Nor is there standard cover for your own loss of turnover from a cancelled season or a closed destination; that is only included case by case and subject to conditions.

What does your premium depend on?

  • Nature of what you offer — Acting as an intermediary for individual bookings weighs less than putting together package holidays with your own guides.
  • Destinations and area of cover — Europe, worldwide and higher-risk areas are assessed and priced differently.
  • Number of travellers per year — The volume of bookings and participants is the usual basis of calculation for the liability section.
  • Active or adventure activities — Water sports, winter sports, climbing and guided cycling tours increase the injury risk considerably.
  • Your own staff on site — Tour leaders and guides abroad count towards the payroll and call for suitable employer cover.
  • Own transport or accommodation — Owning coaches, boats or your own site adds buildings, own-damage and possessor's liability.

Am I liable for an accident involving a local partner?

That depends on your role and on your file. If you offered the activity as part of your trip, the test is whether you selected and checked the partner with due care; Article 6:171 of the Dutch Civil Code can attribute the mistakes of a party you engaged to you. Evidence of insurance, safety certificates and a demonstrable recheck are then your main defence.

Is the guarantee scheme for package holidays insurance?

No. It is a statutory requirement to provide security in case you become insolvent, operated through a guarantee fund with its own entry requirements and contributions. It protects the traveller against losing the price of their trip and arranges their return in the event of insolvency. For loss you cause yourself, such as injury or a booking error, it provides no cover at all.

Do I have to arrange travel insurance for my guests?

No, that is the traveller's own policy. Medical costs, repatriation, luggage and cancellation for personal reasons run through it. You can point out how important it is and record that in your conditions. Your own cover starts where you are liable for injury or property damage, or where your business itself suffers loss through a supplier failing.

Is loss of turnover from a closed destination covered?

In principle no. Natural forces, strikes, airspace closures and unrest in a country are circumstances involving no physical damage at your end, and business interruption cover usually follows covered property damage. Only with an expressly included extension does such a thing qualify. So treat this category in your conditions and your cash flow planning as a risk you carry yourself.
