Sledging and your insurance

Tobogganing is the most accessible activity of a winter sports week and at the same time the activity that most often turns out to fall outside the winter sports module.

In brief

A toboggan run in the Alps is rarely a sports facility. It is usually a winter walking path or a forest track designated as a toboggan run in winter, shared with walkers and with the mountain hut's snowmobile. There is no piste patrol and no supervision in the evening. Your winter sports module is written for skiing and snowboarding on open pistes and by no means always names tobogganing.

What is distinctive about tobogganing is the make-up of the group. It involves families with children on borrowed or hired toboggans, often without helmets, on a run where the speeds are higher than people expect. As a result two questions come together here that arise separately in other winter sports: who pays for the injury and who pays for the damage to the hired toboggan.

There is a third: the descent from a mountain hut to the valley in the dark, after an afternoon or evening at that hut. Virtually every policy has an exclusion for loss connected with the use of alcohol. For the track version on artificial ice, different conditions again apply; see bobsleighing.

This overview is general in nature and is not personal advice. What is actually covered, including exclusions, limits and the excess, is set out in the policy conditions and the insurance card (verzekeringskaart) of the insurer; you receive both before you take out cover. Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

A natural toboggan run is not a piste

On a prepared toboggan run at a ski area, many insurers include the activity in the winter sports module. A natural toboggan run from a hut is another matter: no supervision, varying surfaces and shared use with walkers. So do not ask whether tobogganing is included, but whether tobogganing on an unsupervised natural run comes under the cover, and have that answer confirmed in writing before you leave.

The descent after a visit to a hut

Many huts stand at the top of a toboggan run and many visitors come down in the dark after an afternoon at the hut. Virtually every travel and accident policy has an exclusion for loss connected with alcohol or drugs, and Article 7:952 of the Dutch Civil Code also allows an insurer to invoke serious fault. A medical statement recording the use of alcohol simply ends up on the table when the claim is assessed.

The hired toboggan

If you crash and the toboggan breaks, that is damage to an item in your care. The care, custody and control exclusion in your liability insurance rules it out, so the hire company sets it off against the deposit or sends you a bill. Ask in advance what amount is involved and check the steering strap, runners and fittings when you take delivery. Photograph any existing damage; that saves argument at the end of the day.

A collision with someone else on the run

A toboggan run is shared with walkers and with other toboggans that have no braking distance. If you hit someone, your liability is assessed under Article 6:162 DCC and the loss runs through your personal liability insurance (AVP). Check whether that policy applies in the winter sports country and what sum insured applies per event. The same policy covers children tobogganing with you; check that they are named as co-insured.

What does your premium depend on?

  • A prepared run or a natural toboggan run — A supervised run at a ski area is assessed differently from an unsupervised run from a hut.
  • Daytime or evening tobogganing — Descending in the dark on a lit or unlit run changes how the risk is judged.
  • The winter sports module or a separate extension — If tobogganing falls within the module, no separate cover is needed; otherwise it is.
  • Number of people insured — Tobogganing is a family activity; the number and the age of the participants both count.
  • Destination — The costs of hospital care and of transport back to the Netherlands differ from one winter sports country to another.
  • Sum insured for liability — In a collision with a walker, this sum determines what is actually paid out.

Insurers weigh these details differently. That is why comparing pays off.

Frequently asked questions

The questions we are asked most often about this.

Is tobogganing in my winter sports module?

On a prepared, supervised run often yes; on a natural toboggan run by no means always. Modules differ widely in the activities they name. Ask the insurer for confirmation that names tobogganing and that makes the distinction between supervised and unsupervised runs clear. Without that confirmation it cannot be established afterwards what was insured.

I collided with a walker on the toboggan run.

Report it to your liability insurer and do not admit liability yourself. The assessment follows Article 6:162 DCC, taking into account speed, visibility and the shared use of the run. Note down witnesses and the exact place. Check whether your policy applies in that country and what sum insured per event was agreed.

The hired toboggan is damaged. Who pays for that?

In principle you do. Liability policies contain a care, custody and control exclusion that rules out damage to items in your care, and that covers hired equipment. The hire company sets it off against the deposit or sends you a bill. Check the toboggan when you take delivery and photograph any existing damage, so that you pay only for what you caused yourself.

Does the alcohol exclusion apply to a single drink at the hut?

The exclusion does not operate at a fixed blood alcohol level but where there is a demonstrable link between the drinking and the accident. In practice that link comes up as soon as the use of alcohol appears in the medical file or the police report. The insurer can also invoke serious fault within the meaning of Article 7:952 DCC.
