The risks of a policy you have never read through

Taking out cover online yourself can work perfectly well. The risk lies not in the channel, but in the assumption that the policy schedule will be right without anyone checking it.

In brief

If you take out cover directly with an insurer without advice, that is called execution only. The insurer carries out what you tell it and does not check whether the cover you have chosen suits your situation. That is a legitimate way of buying insurance, but it shifts the responsibility: whether the sum insured is right, whether the use has been declared correctly and whether an exclusion affects you is entirely down to you.

The biggest risk is the duty of disclosure from Article 7:928 of the Dutch Civil Code. When taking out the policy you have to disclose everything that may be relevant to acceptance: claims history, a criminal record within the period asked about, an earlier refusal or cancellation, the actual use of the home or vehicle. An online form asks about that in a few tick boxes. If an answer is wrong, the insurer may reduce or refuse the payout under Article 7:930 of the Dutch Civil Code.

The second risk is inertia. A policy that runs on unchanged for ten years while you refurbished, moved in with a partner, started a business at home or had solar panels fitted no longer matches reality. See also what goes wrong if the stated use is incorrect.

Three places where it goes wrong

In practice almost every argument about cover comes from one of these three directions.

When taking out the policy

The application

What you tick determines acceptance and, later, the payout.

  • Complete the claims history in full
  • Always disclose an earlier refusal
  • Declare the actual use
  • If in doubt, ask rather than guess
The amount

Sum insured

Too low an amount gives a low premium and a low payout.

  • Rebuild value or contents value calculator
  • Check the guarantee against underinsurance
  • Valuables have a limit
  • Reassess after refurbishment
The small print

Exclusions

The difference in premium usually lies here, not in the cover.

  • Excess per event
  • Limits per category
  • Prevention requirements as obligations
  • Free choice of repairer

What is actually covered, including exclusions, limits and the excess, is set out in the policy conditions and the insurance card (verzekeringskaart) that you receive before you take out cover.

What you should check yourself at a minimum

Two checks that prevent most disappointments when you claim.

Read the policy schedule and the insurance card

The policy schedule contains the details on which the insurer relies: sums insured, type of cover, excess, address, use and the clauses. The insurance card (verzekeringskaart) summarises on two pages what is and is not covered. If anything is wrong, report it in writing straight away, not when you claim. Keep that correspondence. An error you report within the first few weeks is an administrative correction; the same error after a claim becomes an argument about the duty of disclosure.

What is never covered, whatever the channel

Even an extended policy has firm exclusions. Excluded as standard are intent and recklessness under Article 7:952 of the Dutch Civil Code, damage caused by deferred maintenance, wear and design faults, and damage that already existed or was to be expected when the policy was taken out. If a loss occurs, report it as soon as reasonably possible, as Article 7:941 of the Dutch Civil Code requires. Reporting late can harm the insurer's interests and cost you the payout.

What does your premium depend on?

  • Sum insured — rebuild value or contents value
  • Type of cover chosen — basic, extended or all risks
  • Excess — higher excess, lower premium
  • Claims history — over the past few years
  • Use and occupancy — family, rooms or letting
  • Additional sections — glass, valuables, legal expenses

Insurers weigh these details differently. That is why comparing pays off.

Frequently asked questions

The questions we are asked most often about this.

What exactly does execution only mean?

That you choose yourself and the provider merely carries it out, without advice on whether the product suits you. The provider does check whether you can understand the risks, but does not assess your personal situation. If it turns out afterwards that the cover does not fit, you bear those consequences yourself. Where there is advice, there is a duty of care to check that the cover chosen is suitable.

What happens if I have forgotten to disclose something?

That depends on whether the insurer would still have accepted you had it known. If it would have insured you on different conditions, payment is made proportionately. If it would not have accepted you at all, the payout may lapse. Where there is intent to mislead, the right to a payout is forfeited. So disclose what you remember later; correction is usually still possible.

Can I have my online policy checked?

Yes. In many cases an existing policy can be transferred to an adviser's administration without the cover changing or having to be applied for again. We then go through the policy, check the sums insured and the type of cover and flag double or missing cover. Have your policy schedule and the conditions to hand.

How often should I go through my policies?

An annual look at the policy schedule is usually enough, but what matters more are the moments when your situation changes: moving house, refurbishment, moving in together or separating, a business at home, letting rooms, solar panels, a new car or prolonged vacancy. Report such changes straight away. Waiting until renewal means you may have inadequate cover in the meantime.
