NH1816 · compared independently · advice from Finass
Most personal legal expenses cases are not about great principles but about the immediate surroundings of the house: a fence, a contractor, a tree and a local authority granting permission for something.

Personal legal expenses insurance gives you lawyers to handle your case and pays the external costs of a lawyer, an expert or proceedings. The cover is built up from areas of law. Home, consumer matters and traffic are usually in the core; employment, income, tax and assets are often separate modules. What you do not tick is not covered, however reasonable your case may be.
Most disputes arise around your own home: neighbour law and boundaries, nuisance, building work that does not deliver what was agreed, a hidden defect after the purchase and an objection to a neighbour's environmental permit. For the loss you cause to someone else it is not this policy but your liability insurance to act.
Not covered are disputes that already existed when the policy was taken out, cases within the waiting period, conflicts between insured parties on the same policy, criminal cases involving an allegation of intent, and claims that stay below the minimum interest.
The structure of the cover in three parts, with an overview per situation below.
The basic cover insures the essentials; we show what NH1816 and other insurers offer here.
As well as debt collection and contracts, also employment law, disputes about your business premises and disputes with public authorities.
The most complete cover. We compare NH1816's extended versions with the market.
What is covered
| Situation | Basic | Extended |
|---|---|---|
| Dispute with a contractor about work on your home | Yes | Yes |
| Recovering damages for personal injury after a collision | Yes | Yes |
| Employment dispute or dismissal | Provided that | Yes |
| Dispute about a purchase or a delivery | Yes | Yes |
| Tax dispute or dispute about assets | No | Provided that |
| A dispute that was already running before the start date | No | No |
Legal expenses insurance has a waiting period after the policy starts and a threshold: a case is not taken on below a certain financial interest. If the case goes to court, you have a free choice of lawyer. A dispute whose cause already existed when you took out the insurance is excluded.

This overview concerns our service, not the cover. What is actually covered is set out in the policy conditions and on the insurer's insurance card (verzekeringskaart); you receive both before you take out cover.
Four points that make the difference between a policy that pays out and one that does not.
Disputes about the position of a boundary fence, overhanging branches, roots lifting the paving or a tree too close to the boundary fall under the home area of law. They take a long time because a surveyor or a land registry reconstruction is often needed. The insurer only reimburses those costs if the case has been taken on. Keep the correspondence with the neighbours, because the run-up determines how the lawyer builds the case.
If the contractor finishes late, defectively or much more expensively, that is a dispute about the contract for work. The lawyer gives notice of default, has the defect established by a surveyor if necessary and claims repair or cancellation. It is important not simply to have the work finished by someone else before the defects have been recorded; that destroys the evidence the whole case rests on.
In a neighbour dispute it happens that both parties have the same legal expenses insurance. There is a conflict of interest arrangement for that: both parties are then given their own external case handler, so that nobody is represented by the same lawyer. Ask for it actively as soon as you suspect it. The same applies if you disagree with the assessment of your chances; there is then a disputes procedure with an independent opinion.
Administrative law cases, such as an objection to an environmental permit, an enforcement decision or a zoning plan, have absolute deadlines. If the deadline is missed, the case is lost before a lawyer has looked at it, and no policy can repair that. So report as soon as you receive the decision, not once the wrecking ball is ready. Article 7:941 of the Dutch Civil Code requires you to report without unnecessary delay in any case.

Insurers weigh these details differently. That is why comparing pays off.
Customers rate our service on four aspects: personal service, service delivery, availability and the outcome. The reviews are collected and published by NH1816 and come from customers who have actually taken out a policy with Finass Advies B.V. or reported a claim.
The questions we are asked most often about this.
Yes, and there is an arrangement for it. As soon as both parties are with the same legal expenses insurer, the conflict of interest arrangement applies: you each get your own case handler, at least one of whom comes from outside. Report it as soon as you notice, so that no file stays with the same lawyer. It does not limit your cover.
Usually yes, provided you bought the house after the policy started and the waiting period had ended. The dispute is about whether the seller breached the duty to inform and whether you met your duty to investigate. Have the defect recorded by a surveyor first and do not repair it straight away, because without evidence of the state of the property at the time of purchase your position is weak.
If your policy includes the home area of law with administrative law, yes. Watch the deadline for objecting, which starts to run from the publication of the decision and not from the moment building starts. A missed deadline is final. So report immediately after publication, even if you are still unsure whether you want to take it further.
After the waiting period set out in your conditions, and only for disputes whose cause lies after the start date. A simmering conflict already under way therefore falls outside it, even if it only escalates later. If you knew of it when you applied, you had to declare it under Article 7:928 of the Dutch Civil Code.
