What else needs arranging alongside the business car policy

In brief

Every vehicle with a registration number needs liability cover under Article 2 of the Dutch Motor Insurance Liability Act (WAM) . That cover pays the other party's loss. What it does not pay is the loss suffered by your own employee who caused the accident. If staff drive for work, Article 7:611 of the Dutch Civil Code brings an obligation to insure that road risk properly. That is done with separate employers' cover; the difference between the versions is set out at WEGAS and WEGAM. Relying on public and employers' liability insurance is no use: it has an exclusion for damage caused with or by motor vehicles.

The second layer concerns what you carry. Own-damage cover repairs the vehicle, not the contents. If you move your own equipment, materials or samples, that belongs on a own goods in transit insurance. If customers' goods travel with you, a goods in transit insurance comes into play. Tools in the van are insured separately, with attention to the overnight provision; see the tools insurance.

The third layer is the equipment itself. A forklift, telehandler or mini digger belongs on plant and machinery insurance, a towed skip or trailer on a trailer insurance. If more vehicles are on the road, a single fleet insurance becomes more practical than a string of separate policies. For disputes about a collision, a repair or a lease contract there is business legal expenses insurance.

This page deals with one situation. The full overview is on Compare car insurance.

Where the gaps fall

Four places where one policy stops and the next has not yet started.

The driver at fault gets nothing

If your employee causes the collision, the third-party liability cover only pays the other party. Their injury and loss of income go uncompensated, and it is precisely for those that they can hold you liable as their employer. Without road traffic injury or employers' cover the business carries that claim itself, even if there was nothing wrong with the car's maintenance.

The load is not part of the vehicle

In an overturning, fire or theft, own-damage cover pays for the bodywork and the fitted-out interior stated on the policy schedule. What was in or on it is excluded: materials, equipment, samples and tools. Also, a poorly secured load that falls off the vehicle and causes damage leads to an argument about blame.

The trailer is a risk object in its own right

As long as a trailer is coupled to the towing vehicle, liability runs through that vehicle's WAM cover. If it comes loose and comes to a stop, or if it is parked, that connection is broken. Own damage to the trailer itself and to what is on it needs its own cover in any event.

What appears on none of these policies

Traffic fines and administrative sanctions are excluded everywhere; they are a punishment, not a loss. Damage caused intent or recklessness falls under the exclusion in Article 7:952 of the Dutch Civil Code. And if someone drives without a valid licence or under the influence, own-damage cover falls away and the third-party liability insurer recovers its payment from the driver.

What does your premium depend on?

  • Number and type of vehicles — cars, vans and plant are weighted differently
  • Number of employees who drive — decisive for employers' cover on the road
  • Value of the items carried — the basis for own transport and tools
  • Security and storage — a lockable site and alarm class both count
  • Area of cover — journeys outside the Netherlands change the risk
  • The company's claims history — with several policies the insurer looks at the whole picture

Insurers weigh these details differently. That is why comparing pays off.

Frequently asked questions

The questions we are asked most often about this.

Why does my public and employers' liability insurance not cover the road?

Because motor vehicles are excluded on virtually every liability policy. The road risk is placed by law with the compulsory WAM cover on the vehicle, and insurers do not want the two systems to overlap. What the WAM cover does not deal with, namely your employee's own loss, belongs on separate employers' cover for road use.

Do I have to insure tools separately if they are always in the van?

Yes. After a break-in the van's own-damage cover pays for the lock and the bodywork, not for the contents. Tools insurance does, but it sets requirements about the circumstances: many policies exclude theft at night if the vehicle was not in a locked space, and require signs of forced entry.

Does a forklift used only on our own site need insurance?

For liability, the question is whether the site is open to the public. As soon as the machine uses even a short stretch of public road, the insurance obligation in Article 2 of the Dutch Motor Insurance Liability Act (WAM) applies. Damage to the machine itself and to items you move with it falls under plant and machinery insurance in any event, and not under a motor policy.

Can I place all of this with one insurer?

Often yes, and it saves administration and arguments about which policy applies. We compare several insurers objectively and look at the conditions for each cover, not just at the bundle. A package is good value as long as the weakest section still matches your real risk; where it does not, a separate policy on that point is wiser.
