Liability insurance for care and welfare

In care, liability is personal and the loss is usually injury. Disciplinary law is added to that, and those are proceedings where you incur costs even without being liable.

In brief

Care providers, therapists, dietitians, educationalists and social workers work in a treatment relationship. If something goes wrong, it usually involves injury or loss caused by incorrect treatment or advice.

Alongside civil liability there is professional disciplinary law. A disciplinary complaint costs time and legal assistance, even if it turns out to be unfounded. Check whether those costs are insured.

What to look out for

Insuring assistance in disciplinary proceedings

Disciplinary proceedings are separate from liability but still cost money. Not every policy covers assistance in them.

The description of your profession

Forms of treatment not stated on the policy are not covered. If you add a technique or a client group, report it.

Professional association and registration

Many insurers require registration in a professional register and compliance with the professional code as a condition.

Client data

You process special categories of personal data. A data breach in care weighs more heavily; cyber cover is far from a luxury here.

What determines the premium

  • Profession and form of treatment
  • Annual turnover or number of clients
  • Sum insured per claim
  • Registration and professional code
  • Claims history

Calculate the premium

This information is general in nature and is not personal advice. What is actually covered, including exclusions and the excess, is set out in the policy conditions and the insurance card (verzekeringskaart) of the insurer; you receive both before you take out cover.

Frequently asked questions

Does my policy cover a disciplinary complaint?

Not always. Disciplinary law is separate from civil liability; check whether the cost of assistance is insured.

What if I offer a new form of treatment?

Report it. The policy covers the activities stated on it; a form of treatment that has not been reported is not insured.

Does my professional association impose requirements?

Often yes: registration in a professional register and compliance with the professional code are regularly underwriting conditions.

Do I also need cyber insurance?

If you process medical data, it is strongly advisable. Special categories of personal data make a data breach more serious and more expensive.
