What is special is that third parties use your structure. If a scaffold collapses or topples during use, the erection and the inspection are examined first, even if weeks have passed.

Record the inspection and release

A scaffold tag with the date, inspector and release is the first document asked for after a collapse.

Modifications by third parties

If another party removes a guard rail or a tie, liability shifts. Record the condition in which you handed the scaffold over.

Falling parts and wind

Scaffold parts, netting and sheeting that come loose in the wind cause damage in the street. Anchoring and wind loading belong in the design.

Working above the public highway

With scaffolding above a pavement or street your liability towards passers-by weighs heavily; set the sum insured accordingly.

Am I still liable once the scaffold is up?

Yes. After a collapse the erection and the inspection are examined, even weeks later. Your scaffold tag and release document are then decisive.

What if another party alters the scaffold?

Then liability shifts, provided you can show the condition in which you handed it over. Record that with photographs and a signature.

Is damage to the scaffold itself covered?

No, that is your own equipment. Insure it under a plant or business contents policy.

What applies to scaffolding above the public highway?

Your liability towards passers-by then weighs heavily. Provide screening and set the sum insured to match that risk.

Which sum insured do clients require?

That is set out in the contract or specification and varies widely by sector; in industry and petrochemicals it is often several million per claim. Ask for the requirement before you tender.

What is the difference between the AVB and the BAV?

The AVB covers damage to property and injury to people. The BAV covers pure financial loss: financial disadvantage caused by an error, without anything being broken or anyone being injured. In downtime and delay claims, that is the difference that counts.
