In brief

At a campsite, holiday park or day leisure business, the buildings policy insures the buildings: the reception and canteen, the sanitary block, the catering area, stores and workshops, and the fixed installations such as electrics, water supply and heating. Site features such as hard surfacing, lighting and fencing can be included as well. Movable property — kitchen equipment, furniture, play equipment, machinery — belongs on the business contents and goods insurance.

Rental accommodation needs attention. Fixed chalets and holiday homes on foundations are often regarded as buildings, while static caravans and movable units are treated by many insurers as movable property or under a separate section. If they belong to guests, those guests insure them themselves and your only interest is your liability as the possessor of the structure (Article 6:174 of the Dutch Civil Code).

The business activity on the policy has to cover the full use. A park insured as a camping site but which also runs a restaurant, a swimming pool and a rental fleet has been incompletely declared. That touches Article 7:928 of the Dutch Civil Code and Article 7:930 of the Dutch Civil Code. See also business buildings insurance.

Four points for leisure businesses

These subjects determine whether the policy actually pays on a claim during the season.

Report all activities, not just the main one

Leisure businesses grow organically: the campsite gains a restaurant, the park a wellness area, the riding stable a function room. Every activity has its own fire and liability risk. If the policy states only the original business activity, the risk has been assessed incompletely. Under Article 7:928 of the Dutch Civil Code you have to report this, and under Article 7:930 of the Dutch Civil Code the insurer can reduce or refuse the payout where it has been concealed. Update the description each year.

Outside the season there is a vacancy

A park that is closed from November to March stands empty in the insurer's eyes. There is no supervision, a leak or frost damage is only discovered weeks later and the chance of burglary and vandalism rises. Most policies limit the cover during that period to fire, storm and explosion or set conditions: draining the pipes, switching off installations and a demonstrable inspection round. Record what you agree and keep a logbook.

What is not covered

Excluded from cover are, among other things business downtime without separate business interruption cover, settlement, subsidence and damage to foundations, defects caused by deferred maintenance and wear and tear, and design faults, for example to a canopy or play feature you built yourself. Intent and recklessness on the part of the insured are excluded under Article 7:952 of the Dutch Civil Code. Damage connected with use that differs from the declared trade description is also a ground for refusal in its own right, and guests' property is never covered by your buildings policy.

Business interruption works differently in a seasonal business

In a leisure business the loss is not spread evenly over the year: a fire in February costs little turnover, the same fire in June costs a whole season. So choose an indemnity period that runs at least through the following high season, because rebuilding with a permit procedure rarely makes the next summer. Support the turnover figures with the monthly figures from previous years, so that no argument arises about the period lost when you claim.

Do static caravans and chalets fall under buildings insurance?

That depends on the construction and the ownership. A chalet or holiday home standing permanently on foundations is often classed as buildings. A movable static caravan usually counts as movable property and calls for a separate section or policy. Accommodation owned by guests is insured by them; you cannot include it on your policy.

Am I liable if a guest falls because of a loose paving slab?

Possibly. As the possessor of the structure you are liable under Article 6:174 of the Dutch Civil Code for damage caused by a defective building or site feature. That liability does not run through the buildings insurance but through public and employers' liability insurance (AVB). For a leisure business with a lot of visitors, that cover is at least as important as the buildings cover itself.

Is the swimming pool insured?

A fixed, in-ground pool with its associated plant room is usually insured as buildings or a site feature, provided you have declared it and included it in the sum insured. Inflatable and above-ground pools count as business contents. The plant itself, such as pumps, filters and dosing equipment, often falls under business contents or under separate machinery breakdown cover.

What happens with frost damage during the winter closure?

Frost damage to pipes is usually only covered if you took reasonable measures: draining the pipes or heating the building sufficiently. Many policies include an express clause about this for the period the business is closed. If you cannot show that you carried out the measures, the damage is often not paid or only paid in part.

Can I put all the buildings on one policy?

Yes, that is usual for leisure businesses. The schedule states for each building the use, the construction type and the sum insured. That makes clear which building carries which rate and prevents a catering area or store added later from remaining uninsured. Report new build and alterations straight away, even for a simple shed.
