In brief

A kite pulls with great force and has a wide range. Anyone losing control on a beach start drags the canopy across a strip where walkers, children and beach bars are. Injury to third parties or damage to a car parked along the beach is judged under Article 6:162 of the Dutch Civil Code and lands on your personal liability insurance, not with your travel insurance.

There is a pitfall there. Many liability policies exclude damage caused with a vessel, with an exception for small sailing objects. Whether kitesurfing equipment falls within that exception differs by insurer. Have it confirmed in writing that kitesurfing falls under your policy; see also liability insurance.

For your own injury the ordinary route applies: kitesurfing is named as a special sport on most travel and accident policies and is excluded without a declaration. Damage to equipment is a third question. The kite, board, lines and harness are luggage, but then only against theft and damage from outside, and not against what happens to them while surfing.

What does your premium depend on?

  • Recreational or in competition. Competitions, freestyle events and speed runs are assessed separately.
  • At home or abroad. Whether you surf mainly on Dutch beaches or also at distant destinations with limited assistance.
  • Frequency and season. A single holiday week is insured differently from surfing all year round.
  • Value of the equipment. The number of kites, the board and the harness determine the limit chosen on the luggage cover.
  • Sum insured for liability. With injury on the beach this sum is decisive, not the payment of your own medical expenses.
  • Experience and training. A completed kitesurfing course and demonstrable hours are taken into account in acceptance.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

The kite is your biggest liability risk

A canopy that gets away keeps pulling. On a busy beach that can cause broken bones to people who have nothing to do with the sport. That is a claim which mounts up quickly and which you carry yourself if your liability insurance excludes this sport. Check the sum insured per event and the territorial scope, because with kitesurfing you often surf abroad.

Designated zones and seasons

Local authorities and beach managers designate zones where kitesurfing is allowed, often with a restriction in high season and with prohibited stretches near bathing areas and nature reserves. If you launch outside that zone, you are acting contrary to a local rule. That considerably weakens your position if you are held liable and can give the insurer grounds to rely on Article 7:952 of the Dutch Civil Code.

Salt, sand and wear

Luggage cover pays for theft from a locked space and damage from outside, for example when the kite blows off the roof during transport. A torn canopy after a crash, snapped lines and salt water damage are excluded; that is damage through use. Store the equipment in a locked space, because with virtually every insurer a kite bag in a car or under a tarpaulin does not count as properly stored.

Hired equipment, lessons and teaching

If you hire a set from a school, the care, custody and control exclusion in your liability insurance excludes damage to that item: the school recovers it from you or deducts it from the deposit. If you take lessons, the instructor is liable for his own mistakes, but not for the nature of the sport. If you give paid lessons yourself or hire out equipment, it is professional and falls outside every personal policy.

Does my liability insurance cover damage caused by my kite?

You must check that explicitly. Liability policies have an exclusion for damage caused with a vessel, with an exception for small sailing objects. Whether kitesurfing equipment falls under it differs by company. Ask for written confirmation naming kitesurfing specifically, and watch the territorial scope outside the Netherlands.

Is my kite equipment insured against damage?

Only against theft and damage from outside, such as in a break-in or during transport. A tear in the canopy after a crash, snapped lines and salt water damage are damage through use and fall outside the luggage cover. Store the set in a locked space and keep the purchase receipts. Without evidence of value and of proper storage, refusal almost always follows.

I surfed outside the designated zone. Does that have consequences?

Yes. Outside the permitted zone you are acting contrary to a local rule, which counts heavily if you are held liable and can give the insurer grounds to rely on Article 7:952 of the Dutch Civil Code. Check for each beach which zones and which periods apply. Those rules differ by local authority and change in high season.

I damaged hired equipment. Who pays for that?

In principle you do. The care, custody and control exclusion in your liability insurance excludes damage to items in your care, and hired equipment falls under it. The school sets it off against the deposit or sends an invoice. Ask in advance what amount is involved and photograph the set when you receive it, including lines and bar.
