In brief

Being out of work lifts no insurance obligation at all. The health insurance remains compulsory for everyone living in the Netherlands, even without income from work; if you stop paying, a payment arrangement follows and ultimately an administrative premium. If you have a car in your name, the third-party liability obligation under Article 2 of the Dutch Motor Insurance Liability Act (WAM) applies undiminished, even if the car is standing still. If you want to be rid of that premium, suspending the registration is the only proper route.

Your own non-life policies simply continue: liability, home contents, buildings, car, travel and legal expenses attach to you, not to your employer. It is, however, wise to report a change of occupation. Some policies, such as legal expenses with an employment module or disability cover, are based on your occupation and income.

What does fall away are the arrangements that ran through the employer: a group health insurance, accident cover for staff, a WEGAS or WEGAM cover for work-related accidents, and legal expenses cover through an employer or a trade union. Those normally end on the last day of employment.

What stays, what lapses and what you arrange yourself

Three groups together determine where you stand without work.

Stays

What is in your name

Your own policies continue, whatever your employment situation.

  • Health insurance remains compulsory
  • Liability and home contents continue
  • The third-party obligation on the car still applies
  • A change of occupation does have to be reported
Lapses

What ran through the employer

Group arrangements end when the employment ends.

  • Group health insurance and discount
  • Accident cover for staff
  • WEGAS and WEGAM cover
  • Legal expenses cover through the employer

What you take on yourself

A few choices you are best making before you are out of work.

  • Your own legal expenses cover with an employment module
  • Continuing health insurance individually
  • Reviewing the payment term and the excess
  • Suspending the car registration instead of cancelling the policy

What is actually covered, including exclusions, waiting periods and excess, is set out in the policy conditions and the insurance card (verzekeringskaart) you receive before taking out cover.

What you run into

Two points that determine whether you have the right cover at the right moment.

Taking out legal expenses cover afterwards does not work

Legal expenses insurance (rechtsbijstandverzekering) almost always has a waiting period and excludes disputes that already existed when you took out the cover or were reasonably foreseeable. Anyone who only calls once the conversation about dismissal has taken place is too late. The same applies to a mortgage payment protection insurance: that normally has a waiting period, an excess period and no cover if you resign yourself or leave by mutual consent.

Report your changed situation

Your occupation, your income and the use of your car are risk information. If anything there changes, report it; the duty of disclosure under Article 7:928 of the Dutch Civil Code applies when the contract is entered into, and the conditions usually also require changes to be reported. If that is not done, the payment can be reduced or refused (Article 7:930 of the Dutch Civil Code). Also excluded are intent and recklessness (Article 7:952 of the Dutch Civil Code) and loss arising from a profession or business on a private policy.

What does your premium depend on?

  • Type of cover chosen — limited, extended or comprehensive
  • Occupation and income — count towards employment-related cover
  • Excess — higher excess, lower premium
  • Household composition — single person or family
  • Postcode area — burglary, storm and water risk
  • Package and payment frequency — bundling and paying annually make a difference

Insurers weigh these details differently. That is why comparing pays off.

Frequently asked questions

The questions we are asked most often about this.

Do I have to keep my health insurance while out of work?

Yes. The obligation to insure attaches to living in the Netherlands, not to working. Your policy simply continues and you remain liable for the premium. If your income falls away, check whether you qualify for the healthcare allowance and whether your voluntary excess is still appropriate. If you cannot pay the premium, contact the health insurer in good time to agree an arrangement.

What happens to the insurance that ran through my employer?

It generally ends on the last day of your employment. Think of a group health insurance with a discount, accident insurance for staff and WEGAS or WEGAM cover for accidents during work or commuting. When you leave, ask on what date the cover stops, so that you are not unintentionally uninsured for a period.

Can I stop paying the premium on my car insurance?

Only by selling the car or suspending the registration with the RDW (the Dutch vehicle authority). As long as a registration is in your name and has not been suspended, Article 2 WAM requires you to have at least third-party liability cover; cancelling leads to a fine. Suspension lifts that obligation, but you may then not park or drive the vehicle on public roads.

Do I have to report that I no longer have work?

On most non-life insurance, occupation is not a premium factor and nothing changes. On legal expenses insurance with an employment module, disability cover or mortgage payment protection it is: there your occupation and income determine the cover and the premium. If you are unsure, report the change; at most it costs an adjustment to the premium and it prevents argument when you claim.
