In brief

Two documents go with an insurance policy and are often confused. The insurance card (verzekeringskaart) is a standardised two-page summary, intended so that you can put products from different companies side by side. The policy conditions form the contract. If the two conflict, the conditions govern. Anyone who assesses cover on the card alone misses the exclusions, the limits and the excess — precisely the elements that give rise to argument after a loss.

There are also registers that hold your details without your managing them yourself. Your no-claims years are recorded with the industry facility insurers use for that purpose; claims and cancellation data are recorded with Stichting CIS; vehicle details come from the RDW (the Dutch vehicle authority). If something in those files is wrong, it feeds through into every quotation you request. You have the right to see those details and have them corrected.

For supervision and disputes there are fixed addresses. The AFM (the Dutch financial markets authority) keeps a public register of licence holders, in which you can check whether an adviser is authorised to act as an intermediary. If you cannot resolve matters with your insurer or adviser, Kifid (the financial services complaints institute) is the complaints body for consumers. You will find the companies we work with on comparing insurance companies.

This overview concerns our service, not the cover. What is actually covered is set out in the policy conditions and on the insurer's insurance card (verzekeringskaart); you receive both before you take out cover.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

The conditions take precedence over the summary

An insurance card (verzekeringskaart) is drawn up in a fixed format and states only the main points. Your rights derive from the policy conditions and from your policy schedule with the clauses. Keep both digitally and, on renewal, look out for a new version number: insurers may change the conditions. If you want to know whether something is covered, search the conditions for the terms exclusions, excess and sum insured, and not the brochure.

Three exclusions you will find in almost every policy

Intent and recklessness are excluded; Article 7:952 of the Dutch Civil Code provides that an insurer does not pay for loss the insured caused intentionally or through gross negligence. Wear and tear, inherent defect and deferred maintenance fall outside every general insurance policy, because there is no sudden event. And damage caused by acts of war and nuclear reactions is excluded as standard. Anyone who knows those three understands the majority of refusals.

Report in time or it goes wrong

Article 7:941 of the Dutch Civil Code requires you to report a loss as soon as reasonably possible and then to give all the information the insurer needs. If you report late and the insurer's interests are harmed as a result, it may reduce the payment. If you deliberately provide incorrect information, the right to payment is lost entirely. So record the circumstances, the date and the people involved straight away.

Your own file held by others

No-claims years, claims reported and any cancellation are held in registers that insurers consult between themselves. Those details determine your no-claims step and sometimes whether you are accepted at all. Request them if a quotation differs inexplicably from what you expected. Incorrect entries do occur, for example after a claim that was ultimately paid by the other party but was never reversed in the file.

What does your premium depend on?

  • Registered no-claims years — Recorded in the industry facility insurers consult; you can request your own position and have it corrected.
  • Claims history at Stichting CIS — Previous claims and cancellations are visible to every affiliated insurer and count when cover is assessed.
  • Object details from official registers — Vehicle details and property characteristics come from registers such as those of the RDW and the Land Registry, not from your declaration alone.
  • Sum insured chosen — The limit per event appears on the policy schedule and is the most important basis of calculation on almost every general insurance policy.
  • Excess chosen — This also appears on the policy schedule and can differ per section of cover; check it for each module.
  • Clauses on the policy schedule — Loss prevention requirements and restrictive clauses reduce the premium but impose obligations on you that are tested when you claim.

Insurers weigh these details differently. That is why comparing pays off.

Frequently asked questions

The questions we are asked most often about this.

What is the difference between an insurance card and the policy conditions?

The insurance card (verzekeringskaart) is a short, standardised summary with which you can compare products. The policy conditions are the contract and contain the exclusions, limits, clauses and obligations. Where the two differ, the conditions govern. Use the card to make a first selection and the conditions to judge whether your particular situation is really covered.

Where do I check whether an adviser has a licence?

In the public register of the Netherlands Authority for the Financial Markets. It shows, for each firm, which products and services the licence covers. Acting as an insurance intermediary is only permitted with such a licence. The register says something about authorisation, not about quality. Also look at the services document, which sets out how a firm is paid and how many companies it compares.

Where do I file a complaint about my insurer?

First with the insurer or the intermediary itself, through its own complaints procedure. If you cannot resolve it together, as a consumer you can go to Kifid, the complaints institute for financial services. The internal procedure has to have been completed first and a time limit applies for submitting the complaint. Going to the civil courts always remains open as well.

Can I see what has been recorded about me?

Yes. You can request your no-claims years and ask Stichting CIS for access to what insurers have recorded about you. If something is wrong, you can request a correction. That is worth doing when quotations are consistently higher than expected or when an application is refused without a clear reason.
