In brief

A 500 collects damage in small portions: a mirror that has been clipped, a scratch from a bicycle handlebar, a small dent from a tight parking bay. Because the amount looks small, reporting is put off until it suits. That is a misunderstanding of how a policy works. Article 7:941 of the Dutch Civil Code requires you to report an event as soon as reasonably possible, even where you do not yet know whether you want to claim.

If you report late, you do not automatically lose your right. The insurer may only rely on it where the late notification has harmed a reasonable interest, for example because the damage can no longer be assessed or the other party can no longer be traced. A deliberately incorrect or misleading statement is another matter: the right to payment then lapses entirely.

There is also a clock running that many owners do not know about. Under Article 7:942 of the Dutch Civil Code a claim against the insurer is in principle time-barred after three years. If the insurer definitively rejects your claim, a short period of six months remains in which to challenge that rejection. If you do not respond, the matter is closed after that, however right you were.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Reporting is not the same as claiming

A notification keeps your file open. Only after that do you decide whether to have the damage paid. For the duty to notify in Article 7:941 of the Dutch Civil Code it makes no difference how small the amount is. So report the scratch you suspect you will pay for yourself as well, and ask what the insurer would pay. If claiming turns out not to be worthwhile, with many companies you can still decide against a payout.

What reporting late means

The insurer has to show that it has been prejudiced by your inaction. It manages that more easily than you think: without prompt notification it cannot send an assessor, cannot establish what happened and cannot recover anything from another party who by now cannot be found. If that prejudice is shown, it may reduce the payout. So report first and gather the details afterwards.

Having it repaired yourself without reporting it

If you have the damage repaired first and submit the invoice later, there is nothing left to investigate. The insurer can then no longer assess the extent of the damage, what happened and whether the amount was reasonable. The burden of proof is on you. If you do want to go ahead with the repair, photograph every side, keep the parts that were replaced and ask for an itemised estimate.

The time limits after a rejection

If the insurer definitively rejects the claim, under Article 7:942 of the Dutch Civil Code you have six months to challenge that decision in court. In addition there is the three-year limitation period, which you can interrupt in writing. Beyond all that, the following remain excluded: wear and fading paint, rust, damage that was already there before the policy started, and damage caused by intent under Article 7:952 of the Dutch Civil Code.

What does your premium depend on?

  • Number of claims paid. It is not the notifications but the payouts that count at renewal and on acceptance.
  • Excess chosen. It determines from what amount of damage claiming produces anything at all.
  • Type of cover. Slight damage through your own actions falls only under comprehensive cover, not under third-party, fire and theft.
  • Version and drivetrain. The 500 is supplied both with a combustion engine and fully electric. Those are different rating groups.
  • Market value of the car. Where the value is low, slight damage is sooner a large part of the payout.
  • No-claims years. An at-fault claim paid out pushes your step down and feeds through into the premium for years.

Do I have to report damage I am going to pay for myself?

Yes. The duty to notify in Article 7:941 of the Dutch Civil Code is separate from whether you make a claim for payment. Reporting costs you nothing and keeps open the possibility of claiming later. Only when the insurer actually pays does it affect your bonus-malus step. When you report it, ask straight away what would be left after deduction of the excess.

How long do I have to report a claim?

The law does not name a fixed number of days, but speaks of as soon as reasonably possible. The policy conditions often do state a period. If you report later, the insurer may only hold that against you where it has been prejudiced, for example because what happened can no longer be established or recovery from the other party has been lost.

My claim has been rejected. How long can I still do something about it?

After a definitive rejection you have, under Article 7:942 of the Dutch Civil Code six months to bring your claim in court. On top of that there is a three-year limitation period. If you disagree, respond in writing and keep proof of sending. A complaint to the internal complaints department or to the complaints institute does not automatically suspend that period.

Can I still claim if the damage has already been repaired?

You can, but you will be empty-handed if you have recorded nothing. The insurer can no longer have the damage inspected and will assess only what you supply. So keep photographs from before and after the repair, an itemised invoice and if possible the parts that were replaced. Without those documents a rejection is likely.
