An exclusive car: original parts and agreements on use

In insurance terms an exclusive car is difficult not because it was expensive, but because there is hardly a second one on the road.

In brief

Ordinary own-damage insurance works with market value and with depreciation tables built on cars of which there are thousands. With a small production run, a version no longer made or a documented history, such a table says nothing. That is why a policy for exclusive cars works with a value agreed in advance on the basis of a valuation report; Article 7:960 of the Dutch Civil Code makes the question of value a non-issue after a claim.

The compulsory liability cover does not change because of it. As long as the car has a valid registration, the insurance obligation under Article 2 of the Dutch Motor Insurance Liability Act (WAM)applies, even where the vehicle stands indoors for months. If you suspend the registration, that obligation lapses, but so, as a rule, does the cover for use on the road. Fire, theft and damage in storage can continue, provided that is expressly stated on the policy.

Underwriting on these cars turns less on value and more on use: the number of kilometres a year, the storage, the security, who may drive and whether the car stays put in winter. Those declarations are not a formality. What you state on the application falls under the duty of disclosure in Article 7:928 of the Dutch Civil Code; if it turns out to be otherwise, the payment can be reduced under Article 7:930 of the Dutch Civil Code. The structure of the cover in three parts, with an overview per situation below.

Third-party liability insurance

Third-party liability insurance is compulsory by law and covers damage you cause to others with your car, not damage to your own car.

  • Damage to other vehicles
  • Injury to third parties
  • Damage to buildings and objects
  • Damage caused by passengers

Third-party liability + fire and theft

Alongside third-party liability cover, protection against damage to your own car from external causes you cannot prevent.

  • Fire and storm damage
  • Theft and burglary
  • Windscreen breakage and glass damage
  • Collision with animals

Comprehensive insurance

The most complete cover, including for damage you cause yourself, theft and total loss. We compare Ansvar Idea's comprehensive version with the market.

  • Hail damage
  • Damage through your own fault
  • Vandalism
  • Unknown party at fault

This overview concerns our service, not the cover. What is actually covered is set out in the policy conditions and on the insurer's insurance card (verzekeringskaart); you receive both before you take out cover.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Repairs determine the loss, not the value

On a rare car the problem is not the value but the repair: original parts are scarce, lead times mount up and not every repairer may work on it. Record that you choose the repairer or brand specialist yourself and that original parts are used. Without that arrangement the insurer directs you to its own network, which is rarely appropriate on an unusual car.

Mileage, storage and the range of drivers

Insurers accept these cars on the basis of a limited annual mileage, locked storage with an agreed alarm class and a fixed range of drivers. If someone regularly drives who has not been declared, or the car stands somewhere else for a long period, the situation differs from what is insured. Report such changes in advance; afterwards it becomes an argument about an increase in risk.

Driving off the public road

Track days, touring runs with timing, skill events and taking part in concours events almost never fall under the normal cover, not even where the run is organised by a brand club. For a single day a temporary extension can sometimes be arranged, always in advance. If the car is transported on a trailer or in an enclosed vehicle, check who bears the transport risk: the carrier or your own policy.

What is not covered

Outside the cover remain: taking part in speed and skill events and use on a circuit; mechanical failure, wear and engine damage without a collision; loss of value after a proper repair, unless that is expressly insured; hire or carrying people for payment; and damage or theft while the car stood outside the storage declared where the policy imposes that storage as a condition.

What does your premium depend on?

  • Valued amount and type of cover — Third-party liability, third-party liability with third-party fire and theft or comprehensive, combined with the amount fixed.
  • Annual mileage and season — A car driven only in summer and on fine days runs a different risk.
  • Storage and security — Locked garage, alarm class, tracking system and whether the building is occupied.
  • Rarity and availability of parts — The scarcer the parts, the higher the repair costs and the turnaround time.
  • Circle of drivers — The age, driving experience and no-claims years of everyone allowed to drive the car.
  • Purpose of use — Enthusiast use only, commuting as well, or taking part in events and club runs.

Insurers weigh these details differently. That is why comparing pays off.

Frequently asked questions

The questions we are asked most often about this.

Does third-party liability cover remain compulsory if the car stands indoors all year?

Yes, as long as the registration has not been suspended. Article 2 WAM ties the insurance obligation to the registration in your name and not to the use. Suspension is possible through the RDW (the Dutch vehicle authority) and lifts that obligation, but the car may then not go on the public road. In that case choose a policy that continues to cover fire, theft and damage in storage during the suspension.

What happens to the valuation after a claim?

In a total loss the valued amount is in principle paid; that is the essence of an agreed valuation under Article 7:960 of the Dutch Civil Code. Where the damage is repairable, the car is repaired and the valuation stands until its period of validity expires, usually a few years. If that period runs out without revaluation, you often fall back on market value at the next claim.

May I do a track day with this car?

Not under the ordinary cover. Driving on a circuit is almost always excluded, including on a private club day with no competitive element. Some insurers offer a separate, time-limited extension for non-competitive track days; you have to apply for it before the day itself. If you drive without that arrangement, not only the track damage is uninsured but possibly the journey home as well.

The car has been restored and has become more valuable. What now?

Report it and have a new valuation carried out. On exclusive and classic cars the value regularly rises, while an old report fixes the sum insured at an amount the market has long since passed. Also keep the invoices and photographs of the restoration: they form the support for the new report and for the vehicle's provenance.
