Karting circuit insurance via Vereende

On a karting circuit, novices race each other and your crash barrier at speed; the injuries that follow land with you as the operator, not with a motor policy tied to a registration number.

In brief

A kart on a closed circuit does not travel on the public road. The insurance obligation under Article 2 of the Dutch Motor Insurance Liability Act (WAM) does not apply there, and that is precisely why a karting circuit cannot be arranged with an ordinary motor policy. If a guest hits the tyre wall, that is assessed as the operator's liability under Article 6:162 of the Dutch Civil Code: did you give sufficient instruction, provide sufficient supervision, and was the track in good order?

Vereende focuses on risks that regular insurers will not place, and a site where visitors with no driving experience may drive at speed is one of them. We use that product for indoor circuits, outdoor circuits, kart hire and corporate packages with timing, and set the acceptance alongside what the regular market is still willing to do for this type of operation.

What the policy does not resolve is your own equipment. The karts, the crash barriers, the track surface and the storage of fuel or battery chargers fall outside liability cover; those are property insurances. If you also hire out unusual vehicles that do go on the road, we look at the unusual vehicle insurance.

This overview concerns our service, not the cover. What is actually covered is set out in the policy conditions and on the insurer's insurance card (verzekeringskaart); you receive both before you take out cover.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

The track is a structure for which you are strictly liable

A crash barrier that has come loose, a settled track surface, broken fencing or oil on the asphalt makes the track defective. Under Article 6:174 of the Dutch Civil Code you are liable for that without anyone having to show fault on your part; the defect is enough. With indoor circuits, the structure of the enclosure and the ventilation come on top of that. Record daily track checks, because that record is later your only evidence.

A signed waiver is not cover

Virtually every circuit has participants sign a declaration. Where there is injury, such an exclusion clause rarely holds up in full: your duty of care as operator remains and you cannot sign it away. What does count is demonstrable instruction beforehand, visible track rules, marshals along the track and turning away participants who are under the influence. Keep the briefing records and the refusals; without that administration you are empty-handed.

Competitions and timing often fall outside cover

Policies exclude taking part in and organising speed competitions as standard. A free session is something other than a competition with a classification, qualifying and prizes, and it is precisely the latter that carries the turnover for many circuits. Report endurance races, corporate championships and hire to a karting club in advance in so many words, otherwise you only discover the exclusion once an injury has been reported.

Your own karts and equipment are not included

Liability cover reimburses other people's losses. A kart put into the barrier by a visitor remains your loss; recovering it runs through your hire conditions and possibly a deposit. Fire in the fuel store, damage to charging stations for electric karts and damage to the track fittings also fall outside it. The same applies to damage you cause intentionally or with substantial fault, see Article 7:952 of the Dutch Civil Code.

Retroactive cover (prior risk)

Retroactive cover (prior risk) Included for your staff during work.

Defence & legal costs

What does your premium depend on?

  • Indoor or outdoor — A covered hall brings fire, ventilation and structural risks that an outdoor track does not have.
  • Track length and number of karts at once — The more karts on a short track at the same time, the greater the chance of collisions between participants.
  • Type of kart and top speed — Children's karts, two-seater karts and fast sports karts each produce a different injury profile.
  • Visitor numbers per year — The number of sessions per season is the exposure; that weighs more heavily than the size of the site.
  • Supervision and safety measures — A fixed briefing, marshals along the track and remote speed limiting reduce both the likelihood and the extent.
  • Injury claims in the past — Earlier claims from participants weigh more heavily with this type of operation than material damage to the site.

Insurers weigh these details differently. That is why comparing pays off.

Frequently asked questions

The questions we are asked most often about this.

Is third-party liability insurance compulsory for karts as it is for a car?

Not on a closed site. The obligation under Article 2 of the Dutch Motor Insurance Liability Act (WAM) applies to taking part in traffic on the road; a circuit is not that. Liability for injury to participants therefore runs through your operator's cover. If you do drive karts or service vehicles along a stretch of public road, for example between two parts of the site, the insurance obligation does apply there.

Does a signed waiver protect me against claims?

Only to a limited extent. With injury claims, an exclusion clause is examined critically and your duty of care as operator remains. The declaration mainly helps to show that the participant was made aware of the risks. What is decisive is the instruction beforehand, the supervision during the session and the condition of the track; that is what an insurer and a court will test.

Are my instructors and track staff covered?

Only if the employer's liability section is included. If a marshal is injured while towing a kart away, the duty of care under Article 7:658 of the Dutch Civil Code applies and it is not a matter of a third party. If you work with agency workers, placement students or weekend volunteers, declare those groups separately; they do not automatically fall within the description of your staff.

Who pays if a visitor writes off a hired kart?

In principle you do. Damage to your own kart is not a liability claim against a third party and therefore falls outside this cover. If you want to recover those costs, that must follow from your hire conditions, with an excess or deposit per session. Record the damage photographically straight after the session, because afterwards what happened is almost impossible to prove.
