In brief

A liability policy basically covers what goes wrong during the work. Your risk, however, largely lies afterwards. The joint that starts leaking after a fortnight, the system that fails at the weekend, the connection that only gets hot under load: the section for completed workexists for that. If it is not included, your cover stops the moment you hand back the key.

What almost always falls outside the cover is repairing or replacing the part you fitted defectively yourself. The consequential loss around it, such as a flooded floor, failed refrigeration or spoiled stock at your client's premises, can in principle be insured. That distinction determines the outcome of virtually every claim.

If you work with naked flames, soldering, welding or grinding on site, separate requirements apply. And as soon as an installation becomes part of the building, the owner can be held liable under Article 6:174 of the Dutch Civil Code and will then come knocking at your door. For project work we also look at a Construction all risks (CAR) insurance.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Completed work is a separate section

Damage arising after you have finished the work is not automatically covered by the liability cover. The completed work section deals with that, usually with its own limit and sometimes with a time limit after completion. For installation firms this is the most important extension to the policy, because with water, gas, electricity and refrigeration a mistake only comes to light under normal load.

Hot work calls for a permit and a fire watch

Soldering, welding, cutting and grinding at a client's site are the classic cause of fire after the working day has ended. Insurers therefore include a clause requiring a hot work permit form, screening of the surrounding area, firefighting equipment within reach and a fire watch for a set period afterwards. Without a completed form your position after a fire is weak.

Your contract is out of proportion to the consequential loss

A maintenance contract with a modest annual fee can lead to consequential loss many times higher, for instance if a refrigeration system in a stock room fails. The policy does not correct that imbalance; you have to do that yourself. Limit your liability in your terms and conditions, refer to them in every quotation and make sure the terms were demonstrably handed over before the contract was concluded.

Refrigerant, gas and soil

If refrigerant leaks away, oil gets into the soil or a tank empties during maintenance, that is environmental damage. Pollution of soil, water or air and the clean-up costs that follow are excluded on liability insurance and belong with environmental damage insurance. Work with drip trays and record fill quantities; after a leak you have to be able to show how much escaped.

What does your premium depend on?

  • Type of installations — Electrical, water, central heating, refrigeration and lifts each have their own consequential loss profile.
  • Completed work included — Whether or not there is cover after completion, and with what limit and time period.
  • Hot work — How much soldering, welding and grinding you do on site and how you record it.
  • Average and largest project size — A single large project can raise the maximum loss considerably.
  • Maintenance contracts with response times — Fixed contracts with a call-out service bring liability for availability with them.
  • Hired-in staff and subcontracting — Under Articles 6:170 and 6:171 of the Dutch Civil Code you remain answerable for whoever works on your behalf.

What does completed work mean on my policy?

It is the section that covers damage arising after you have finished the work. Without that extension your cover stops at completion, while installation faults come to light precisely afterwards. Note the limit and any time period after completion. For installation and maintenance firms this is usually the most important extension to the liability insurance.

Is the leak I caused covered?

The water damage to your client's floor, ceiling and contents is in principle covered, provided completed work is included. Remaking the joint you fitted wrongly is not: damage to the part you supplied or worked on is excluded. That distinction between consequential loss and putting your own work right determines virtually every claim.

What is a hot work permit?

A form stating what hot work takes place where and when, which measures have been taken and who keeps the fire watch. Insurers require it for soldering, welding and grinding on site. If it is not completed and a fire breaks out after you leave, the payment can be reduced because a policy condition has not been met.

Does liability insurance cover soil pollution?

No. Pollution of soil, water or air and the cost of clean-up are excluded on liability insurance. There is environmental damage insurance for that, with its own limit and its own conditions on storage and drip trays. If you work with oil, refrigerant or fuel, that policy is not a luxury but a necessary addition.
