In brief

A chalet on a Dutch campsite or holiday park stands on land with a recreational designation. The zoning plan prohibits permanent living, local authorities enforce it and insurers include a use clause. If you register at the park address in the municipal personal records database, that is an immediate signal to an insurer that the declared use no longer matches.

Unlike a unit across the border, Dutch liability law applies here in full. If the chalet is fixed on foundations, you are the owner of a building and the strict liability under Article 6:174 of the Dutch Civil Code rests on you for defects: a loose roof panel, a sunken terrace, a shed that blows over.

Outside every cover are: flooding and water entering from outside, rising groundwater, permanent occupation, letting you have not declared, and damage caused by deferred maintenance. If your unit is abroad, read the page on Belgium or Germany.

A trailer or caravan is not an independent motor vehicle and therefore has no insurance requirement of its own. Damage you cause to others with it falls under the third-party liability cover of the towing vehicle, as long as the combination is coupled (Article 2 WAM). Once the trailer is uncoupled and has come to a standstill, that cover no longer applies.

Where things go wrong in practice

Four points that make the difference between a policy that pays out and one that does not.

Recreational use is a condition of cover

The policy schedule states that the unit is used for recreation. If you actually live there, even temporarily between two houses, the use differs from what you declared and the insurer can rely on Articles 7:928 and 7:930 of the Dutch Civil Code. This is not only about fire damage: the liability cover for the pitch also hangs on that recreational character. So always declare a change of use in advance.

Building liability on your own pitch

If the chalet is fixed on foundations, you are the owner of a building within the meaning of Article 6:174 of the Dutch Civil Code. That is a strict liability: if something goes wrong because of a defect, the injured party does not have to prove fault. Personal liability insurance (AVP) by no means always covers such a second property. Ask for express liability cover for the pitch and the structures on it.

Rainfall is not the same as flooding

Rain coming in through a leaking roof or the roof light is usually covered. Water flowing onto the site because a dyke or quay gives way is not: flooding is excluded in Dutch policy conditions in almost every case, as is rising groundwater. For parks on flood plains and along regional flood defences, that is the decisive point. Ask how your insurer defines the line between rainfall, water nuisance and flooding.

Park rules, termination and clearance costs

The pitch agreement governs more than the rent: compulsory liability cover, requirements for the awning, terrace and shed, and the duty to remove the unit when the contract ends. That last point comes back after a total loss, because removing and clearing away the wreck costs money and is not automatically part of the policy. Ask whether clearance costs are insured as a separate section.

Many parks require liability cover. Check what the park requires before you take anything out.

Chalet or static caravan: the classification determines everything

If the property stands on a foundation and cannot be moved without being dismantled, it is treated as a building and insured on a rebuild value basis. A movable static caravan falls under caravan-type cover based on the list price. If that classification does not match reality, neither does the valuation: and you only find out when the property is a total loss.

What does your premium depend on?

  • Classification of the object. Fixed on foundations is assessed as a building, movable as a caravan-type unit.
  • Rebuild value or list price. The basis for the payout; rebuilding costs are higher than the purchase price at the time.
  • Location of the park. Coast, woodland edge or flood plain: storm, falling trees and water nuisance weigh differently by location.
  • Own use or letting. Letting through a park organisation or platform changes the risk and must be declared.
  • Contents sum insured and security. What is kept inside permanently and what locks and fastenings the unit has.
  • Liability cover for the pitch. Whether or not it is included, and whether structures such as the shed and terrace are covered.

May I live in my chalet permanently?

Not on a recreational designation, unless the local authority expressly tolerates it or grants an exemption. In insurance terms it is more of a problem: the policy schedule states recreational use as a condition. If the actual use differs, the insurer can reduce or refuse the payout under Article 7:930 of the Dutch Civil Code, even where the cause of the loss had nothing to do with living there.

Is flood damage covered?

Almost never. Dutch policy conditions exclude flooding and water entering from outside, as well as rising groundwater. Rain coming in through a leaking roof or an open roof light is usually covered. If your park is on a flood plain or behind a regional flood defence, ask in writing how your insurer describes the difference between water nuisance and flooding.

Who pays for clearance after a total loss?

That is a separate section. The pitch agreement usually obliges you to remove the unit, even if all that is left is a twisted frame. Removal, tipping charges and restoring the pitch cost money that is not automatically part of the own-damage cover. Ask whether clearance costs are insured and up to what amount per event.

Do I have to report letting?

Yes, always. Letting to third parties changes who is present in the unit, how the installations are used and how often occupants change. Without a declaration, damage during letting is excluded. If the letting runs through the park organisation, also ask what their cover arranges, so that you do not pay double premium for the same cover.
