In brief

You insure a Skyboot as a pleasure craft, but the risk of damage lies differently from a cabin yacht in a permanent berth. A compact open boat goes on the trailer more often, lies at a jetty or at home during the season and stands ashore the rest of the year. As a result the key policy provisions turn not on sailing area and seaworthiness, but on theft, transport and storage.

The motor is the most sensitive part in this. An outboard motor can be detached in a short time and is stolen on its own, even if the boat itself stays where it is. Insurers counter that with a security clause: an approved motor lock, a locked site or a particular form of storage. If such a requirement appears on your policy schedule, it is not advice but a condition. If the security was not fitted or not used at the time of the theft, the insurer may refuse to pay.

Osmosis, corrosion and wear remain excluded, as do damage from deferred maintenance, taking part in speed races, sailing without the required boating licence and hiring the boat out without declaring it. Deliberate acts and recklessness fall outside the cover under Article 7:952 of the Dutch Civil Code. There is no statutory insurance requirement for pleasure craft. The WAM applies only to motor vehicles. Marinas, harbours and hire companies do generally require liability cover. Pay attention to the sailing area described and to the lay-up or winter storage period: outside the sailing area or during undeclared storage, cover may lapse.

Where things go wrong in practice

Four points that determine whether the policy actually pays out in the event of a claim.

The motor is a risk item in its own right

When you apply, give the make, type, power and serial number of the motor and keep the purchase invoice. In the event of theft that serial number is the only way to identify the motor, and without those details a claim becomes difficult. Also check whether the motor falls under the same sum insured as the boat or is listed separately, and what security the insurer requires. A motor on a boat that is on a trailer is a different risk from a motor on a boat in a supervised marina.

On the road, the rules of your motor insurance apply

If the boat travels on a trailer behind the car, the coupled trailer is covered for damage to others by the liability cover of the towing vehicle. That obligation follows from Article 2 of the Dutch Motor Insurance Liability Act (WAM). Once uncoupled and at a standstill, that no longer applies. For the boat itself it is a separate question: not every boat policy covers damage during transport by road. And the trailer is never covered by the boat insurance, but by a policy of its own or by the trailer cover on the car.

Storage at home is not storage in a marina

If the boat stands on the driveway, beside the shed or on an unsecured site, that is a different risk for the insurer from a supervised yard or a locked shed. Give the actual storage address and report any change, for example when you leave the boat at a relative's for a winter. Frost damage because the motor, the cooling system or the pipework has not been drained counts as inadequate maintenance and is not paid for, wherever the boat stands.

Guests on board and watersports behind the boat

An open boat rarely goes out alone. If someone on board is injured without anyone being liable, the liability cover pays nothing. That is what the cover for people on board is for, paying a fixed amount on permanent injury or death. If you tow someone on a board, a ski or a banana boat, check that this is permitted; many policies exclude towing activities and high-speed use or require them to be listed separately. Report a claim as soon as is reasonably possible (Article 7:941 of the Dutch Civil Code).

Winter storage and transport by road

Almost every policy has a lay-up period with limited cover and a lower premium. In those months cover generally remains only for fire, storm and theft. Frost damage because the motor, the cooling system or the pipework has not been drained is not paid for; that counts as inadequate maintenance. Transport by road also calls for attention: not every boat policy covers damage during transport on a trailer, and the trailer itself is never covered by the boat insurance but by a separate policy or the trailer cover on your motor insurance.

Wear and maintenance remain at your expense

Defects that develop gradually — osmosis, corrosion, wood rot and wear: are covered nowhere, and the same applies to damage caused by deferred maintenance. Also excluded are taking part in speed races, sailing without the required boating licence and hiring the boat out without declaring it. Damage caused deliberately or recklessly falls outside the cover under Article 7:952 of the Dutch Civil Code. On the application, state the mooring, engine power and use correctly (Article 7:928 of the Dutch Civil Code) and report a claim as soon as reasonably possible (Article 7:941 of the Dutch Civil Code).

What does your premium depend on?

  • Value of the boat and the motor together. Purchase invoice or valuation, and whether the motor falls within the same sum insured or is listed separately.
  • Engine power and top speed. Determines the risk class and whether a boating licence is required for the craft.
  • Form of storage out of season. Driveway, garden, locked shed or supervised yard. The theft risk differs greatly between them.
  • Security of the hull and the motor. A motor lock, a trailer lock and the question of whether those requirements appear as a clause on the policy schedule.
  • Transport on a trailer. Whether transport by road is included and how often the boat is actually moved.
  • Use and people on board. Day trips with guests, towing activities behind the boat and the cover chosen for people on board.

Is the outboard motor separately covered?

That varies from policy to policy. Sometimes the motor falls within the sum insured for the boat, sometimes it appears as a separate object on the policy schedule. Always give the make, type, power and serial number, and keep the invoice. For theft, a security requirement applies almost everywhere, such as an approved motor lock; if that security is missing at the moment of the theft, cover lapses.

Who pays if the trailer with the boat comes loose?

Damage to others caused by a coupled trailer falls under the liability insurance of the towing vehicle. That follows from Article 2 of the WAM. Once the trailer has come uncoupled and stopped, that no longer applies. Damage to your own boat is covered only if transport by road is included in the boat policy, and the trailer itself always needs cover of its own.

May the boat stand on my driveway at home?

It may, but for the insurer that is a different risk from a supervised yard, and it can lead to a higher premium or a security clause. Give the storage address and report any change, including a temporary one. In winter, remember to drain the motor, the cooling system and the pipework; frost damage is treated as inadequate maintenance and is not paid for.

Do I need a boating licence?

For pleasure craft capable of more than 20 kilometres per hour, and for vessels longer than 15 metres, the small craft boating licence applies. On a compact motorboat the engine power is therefore decisive. If you sail without the required licence, that is an exclusion on almost every policy and the insurer does not have to pay the own-damage claim. Check that before your first trip.
