Frequently asked questions about an HOA package :
What is an Owners' Association (VvE) liable for?

The VvE is liable for all damage or injury to third parties caused by the building. This can be caused, for example, by a storm or by overdue maintenance or negligence. The homeowners' association, and therefore all owners, is then responsible for the damage to the other party.

In addition to liability for the building, the directors are also liable for management actions. If these actions are not carried out properly, the board can be held personally liable. If the board has not insured this risk, mistakes can have serious financial consequences for their private assets.

Are there mandatory insurances for a homeowners' association?

A homeowners' association is obliged to take out building insurance and business liability insurance. These are important because the homeowners' association has obligations towards other parties. This includes owners (protection of assets), mortgage providers, tenants or local residents.

In addition, there are also insurances that are optional. These insurance policies provide coverage for specific risks that depend on the situation and needs of the homeowners' association.

Obliged

  • Business liability insurance
  • Glass insurance

Optional

  • Legal insurance
  • Directors' liability

It is advisable to also take out some individual insurance policies, such as home contents, with the same insurer. It saves time and the coverages are consistent.

Is damage caused by the breaching or flooding of dikes insured?

Damage caused by water that has entered your building as a result of flooding due to the collapse, overflow or failure of a non-primary flood defense is also insured. However, damage caused by flooding is not always insured.
