In brief

The light quadricycle policy comes in three forms. Third-party liability is compulsory and pays only for the damage you cause to someone else. Third party, fire and theft adds a fixed list of causes beyond your control: fire, storm, theft, broken glass, collision with an animal. Comprehensive cover adds damage to your own vehicle through your own doing, including vandalism.

Which form fits is a calculation of value and age. A newly delivered light quadricycle represents an amount that most owners would not want to bear out of their own pocket; on a ten-year-old example that balance tips towards third-party liability only. What decides it is not the replacement value as new but the market value at the time of the loss, unless your policy has a depreciation scheme or an agreed valuation.

Insurance never pays more than the loss suffered; that principle of indemnity is set out in Article 7:960 of the Dutch Civil Code. You report a loss as soon as is reasonably possible, see Article 7:941 of the Dutch Civil Code. Four points that make the difference between a policy that pays out and one that does not.

How an own-damage claim is settled

Where damage is repairable, the insurer pays for the repair less your excess. If repair costs more than the vehicle is worth, a total loss follows: you receive the market value less the residual value of the wreck and less the excess. Many policies apply a depreciation scheme for an initial period after delivery, taking the replacement value as new as the starting point. Ask in advance which period applies and which source of value is used after that.

The excess is a premium dial

The excess applies per event and only to own-damage cover, not to third-party liability. A higher excess lowers the premium, but shifts small claims to your own account. Where glass is repaired rather than replaced, the excess is often waived. Work out at what amount you would still claim; if that lies close to the excess, you are paying a premium for cover you never call on in practice.

Notification, no-claims years and additional modules

Report a loss as soon as possible and cooperate in establishing the facts; late notification may prejudice the insurer and it is entitled to rely on that under Article 7:941 of the Dutch Civil Code . An at-fault claim puts you back a number of steps on the no-claims scale. Alongside the basic cover you can include modules: motor legal expenses cover, personal accident cover for occupants, and roadside assistance. These stand apart from own-damage cover and have limits of their own.

What is not covered

Outside the cover are: wear, mechanical and electrical defects and the consequences of deferred maintenance; loss of value after a proper repair; damage while the vehicle is hired out, used for lessons or used for delivery that has not been declared; theft where the key was left in the vehicle; damage caused intentionally or through wilful recklessness, see Article 7:952 of the Dutch Civil Code; and damage notified so late that the insurer's interests have been harmed as a result.

What does your premium depend on?

  • Type of cover chosen — Third-party liability, third party, fire and theft, or comprehensive cover makes the biggest difference to the premium.
  • Level of the excess — A higher excess on own-damage cover brings the premium down, but shifts small claims to you.
  • Value and basis of value — The list price, the market value or an agreed depreciation scheme determine the own-damage premium.
  • Age of the vehicle — The older the vehicle, the lower the value to be insured and the sooner a total loss follows.
  • No-claims years and claims history — Your step on the no-claims scale feeds straight through into the rate.
  • Modules included — Motor legal expenses cover, personal accident cover for occupants and roadside assistance are charged separately.

When does own-damage cover make sense?

When you would not want to bear the loss of the vehicle from your own resources. On a recently delivered light quadricycle that is almost always the case; on an old one, rarely. Set the own-damage premium plus the excess against the market value. If that market value approaches the amount you pay each year for own-damage cover, third-party liability only is the logical choice.

What is a depreciation scheme?

An arrangement setting out which value the insurer takes as its starting point in the event of a total loss in the first years after delivery. Instead of the market value, the replacement value as new then applies, or the replacement value as new less a fixed percentage per month. The scheme runs for a limited period and usually applies only to the first owner. Ask for the exact period before you sign.

How quickly do I have to report a claim?

As soon as is reasonably possible. Article 7:941 of the Dutch Civil Code requires you to report the event and to cooperate in the investigation. If you wait so long that the insurer can no longer establish what happened, it may reduce or refuse payment. Report damage even where you do not yet know whether you want to claim; reporting is not the same as claiming.

What does a claim cost me in no-claims years?

After an at-fault claim the insurer puts you back several steps on the no-claims scale, which feeds through into the premium for years. Where someone else is liable and the loss is recovered in full, your record stays intact. A third party, fire and theft claim such as broken glass or storm damage generally costs no steps either. Ask your adviser about this in advance.
